Book Hierarchy in International Law

Download or read book Hierarchy in International Law written by Erika De Wet and published by Oxford University Press. This book was released on 2012-03-01 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes an inductive approach to the question of whether there is a hierarchy in international law, with human rights obligations trumping other duties. It assesses the extent to which such a hierarchy can be said to exist through an analysis of the case law of national courts. Each chapter of the book examines domestic case law on an issue where human rights obligations conflict with another international law requirement, to see whether national courts gave precedence to human rights. If this is shown to be the case, it would lend support to the argument that the international legal order is moving toward a vertical legal system, with human rights at its apex. In resolving conflicts between human rights obligations and other areas of international law, the practice of judicial bodies, both domestic and international, is crucial. Judicial practice indicates that norm conflicts typically manifest themselves in situations where human rights obligations are at odds with other international obligations, such as immunities; extradition and refoulement; trade and investment law; and environmental protection. This book sets out and analyses the relevant case law in all of these areas.

Book The European Crisis and the Transformation of Transnational Governance

Download or read book The European Crisis and the Transformation of Transnational Governance written by Christian Joerges and published by Bloomsbury Publishing. This book was released on 2014-11-13 with total page 573 pages. Available in PDF, EPUB and Kindle. Book excerpt: The debate on law, governance and constitutionalism beyond the state is confronted with new challenges. In the EU, confidence in democratic transnational governance has been shaken by the authoritarian and unsocial practices of crisis management. The ambition of this book, which builds upon many years of close co-operation between its contributors, is to promote a viable interdisciplinary alternative to these developments. “Conflicts-law constitutionalism” is a concept of transnational governance which derives democratic legitimacy from the supranational control of the external impact of national decision-making, on the one hand, and the co-operative responses to problem interdependencies on the other. The first section of the book contrasts Europe's new modes of economic governance and crisis management with the conditionality of international investments, and reflects upon the communalities and differences between emergency Europe and global exceptionalism. Subsequent sections substantiate the problématique of executive and technocratic rule, explore conflict constellations of prime importance in the fields of environmental and labour law, and discuss the impact and limits of liberalisation strategies. Throughout the book, European and transnational developments are compared and evaluated.

Book Eight of Swords

    Book Details:
  • Author : David Skibbins
  • Publisher : Macmillan
  • Release : 2007-04-01
  • ISBN : 1429908785
  • Pages : 292 pages

Download or read book Eight of Swords written by David Skibbins and published by Macmillan. This book was released on 2007-04-01 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: A strange thing was happening to Warren Ritter. He certainly didn't believe in the tarot. He was a businessman, setting up a folding table on a San Francisco street where a stream of passersby could bring him as much as a hundred dollars a day when the weather was right. But he was beginning to notice more and more that what he had learned to predict from his tarot cards seemed to be coming to pass with an unsettling regularity. It made him do odd things. Like stop teenage Heather Wellington's tarot at nine cards instead of ten. The first eight had been ominous, the ninth more upbeat, so Warren simply stopped the reading there. It was only after Heather had left that he looked at number ten-it was the Death card. The Death card does not automatically doom the person whose tarot it turns up in. But it doesn't mean there are good things ahead, either. So Warren, the scoffer, couldn't help feeling horror later that day, to see Heather's face on a pizza parlor TV screen with the word Kidnapped! slashed across the top. Guilt, that was what gripped him, as though he could have done something, warned her-but didn't. "Warren Ritter" is not the name he was christened with. He is a fugitive of sorts. Everyone, including his family and the New York police, believes he died in a mysterious incident thirty years ago, and he has no intention of changing that. Now, on top of the guilt he lives with, is the feeling that somehow he is responsible for young Heather Wellington's capture-that it is his call to find her, and to get at the people who took her. Eight of Swords is an astonishing debut novel, and a very different novel from the old notion that a traditional mystery is along the lines of "a dead vicar in the library." Warren's exciting and often dangerous quest through the streets-some of them quite mean-of San Francisco to find the girl and rescue her is more than just a suspenseful tale, it is also a moving portrait of a man returning to the world he had turned his back on three decades earlier.

Book A Place Where Everybody Matters

Download or read book A Place Where Everybody Matters written by Jean Risley and published by Wipf and Stock Publishers. This book was released on 2010-02-17 with total page 141 pages. Available in PDF, EPUB and Kindle. Book excerpt: Small churches need the work of all of their people to survive, and this means that there's a productive place in the church family for every person, no matter how gifted or challenged. Small churches are uniquely personal, and they provide an unparalleled opportunity for Christians to learn, grow, and live out their faith consciously, every day. Small churches become a family, children of God, and brothers and sisters of Jesus together. There's no place to hide in a small church. The normal human dramas of good and evil, sin and repentance, forgiveness and reconciliation all happen in our relationships in the family. A small church is a place where people can serve an apprenticeship in faith, learning from those before them and passing on their experience to those around them. In a small church the pastor provides context by preaching and teaching, serves as a role model in encouraging the ministry of others, and, by loving the people, helps them see themselves through God's eyes. The rest is up to the people themselves and to God.

Book Die Aly is

    Book Details:
  • Author : John M. Whiddon
  • Publisher : Dorrance Publishing
  • Release : 2023-08-14
  • ISBN :
  • Pages : 298 pages

Download or read book Die Aly is written by John M. Whiddon and published by Dorrance Publishing. This book was released on 2023-08-14 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: About the Book Die-Aly$is is the final novel in the mystery series that has come to be known as the “Webb Espy Chronicles.” This thought-provoking third story in the trilogy is more than just a traditional mystery and begins with a Florida Southern District Federal judge, an eccentric individual, and an eclectic jurist, who is well in front of the jurisprudence curve as compared to his legal peers. The sage old legal scholar, in the twilight of his career, has long ago reconciled his moral and ethical thinking related to the hypocritical limitations and archaic institutional precedents existing in the legal arena that restrict common sense. A whistleblower case assigned to his court docket provides the impetus for inserting his conniving influence into the mix to alleviate an egregious wrong. From his catbird seat overlooking the entire gameboard, the judge easily identifies the whistleblower and although he opines she is extremely intelligent and passionate in her pursuit of justice, she is well in over her head and does not begin to appreciate who all the players are, much less the unimaginable danger she placed on herself. The judge, without hesitation, decides to intervene and level the playing field through an orchestrated surreptitious scheme to provide the whistleblower with a supporting cast. That supporting cast is Webb Espy and his talented entourage of “giant killers.” Once achieved, it’s GAME ON! End-Stage Renal Disease and the systems involved with planning, funding, administering, and regulating those providing such services are fraught with aberrant and fraudulent practices. Greed is most often the motive, but not always. Die-Aly$is encapsulates the quagmire of competitive participants that includes mobsters, Corporate America’s prescription for-profit entities, self-referral Houdinis, and corrupt politicians, as well as an arm of the invisible U.S. Government for a share of the booty. As in the previous two books, the characters are unique, sometimes malicious, and often delicious and easy to visualize. The corkscrew unveiling of the plot runs the gamut from black market kidneys to an assassin that does not exist. Beyond the mystery itself, as the story unfolds there are legitimate questions about modern-day Robin Hoods, the moral right of civil disobedience as well as who are the real good guys and bad guys, and whether it is okay to do something wrong to achieve something right. About the Author John M. Whiddon is a native Floridian, born in the small panhandle town of Chattahoochee, Florida. An avid reader and writer with a background in the healthcare industry, Whiddon ran Florida’s Medicaid Program Integrity Office for more than a decade and, upon retirement, opened a private healthcare regulatory consulting business in 1995. Whiddon received his Bachelor’s degree from McMurry College, his Master’s from Florida State University, where he also taught for five years, and his post-graduate work in Public Administration from Nova University. He is a veteran and served in the United States Air Force from 1966 through 1970. He is involved in numerous civic and conservation organizations. He has been married for almost sixty years and has two children and one granddaughter. Book Windows into the Third Heaven

Download or read book Windows into the Third Heaven written by Joanne Carraway and published by WestBow Press. This book was released on 2012-04-03 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: In that hour Jesus rejoiced in spirit, and said, I thank thee, O Father, Lord of heaven and earth, that thou hast hid these things from the wise and prudent, and hast revealed them unto babes: even so, Father; for so it seemed good in thy sight. (Luke 10: 21) The Bible is a book of hidden treasures purposefully designed so by our God. Many of these hidden treasures are complex, yet they can be understood by ordinary people. Jesus likened this group of people to babes. One of the meanings of babes in Greek is simple-minded. God desires to open the windows of heaven and reveal the secrets of His Holy Word to you. If you consider yourself inept or too simple-minded to understand, then all the better! You are just Gods type, and yes, Hes looking for you. He will reveal to you even the hidden wisdom, which God ordained before the world unto our glory (1 Corinthians 2:7). Need more proof? Look at what God promises in Revelation 2:17: To him that overcometh will I give to eat of the hidden manna. May you begin to eat of this hidden manna as you read Windows into the Third Heaven, and may this book be graciously used by the Spirit of God to whet your appetite for more.

But for author Tina Rye Sloan, growing up in tiny Detroit, Alabama, was anything but boring. In her delightful memoir Southern Serendipity, Sloan shares some rather entertaining and almost unbelievable accounts of life in the Deep South. From discovering numerous mischievous uses for dish soap to miraculously surviving a slide off the tin roof of a barn-propelled by a slick coating of baby oil-Sloan provides a look at the rich upbringing she was fortunate to have, despite her family's poverty. Southern Serendipity also offers a glimpse into Southern small-town life during the late 1960s, 1970s, and early 1980s. Sloan inadvertently yet artfully describes many facets of Southern culture, from colloquialisms to gardening to education. The collection of heartwarming stories in Southern Serendipity is based around several families whose lives in this small Southern town were woven together like strong, colorful threads in a tapestry.
