Book Domestic Abuse Disclosure Schemes

Download or read book Domestic Abuse Disclosure Schemes written by Jamie Grace and published by Springer Nature. This book was released on 2021-11-16 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book draws on empirical work to examine the debates surrounding domestic violence disclosure schemes (also known as Clare's Law), focussing on England and Wales with comparisons to similar jurisdictions. Clare's Law allows any member of the public the right to ask the police if their partner may pose a risk to them. This book sets out a coherent methodology for analysing these schemes which are growing in popularity. It discusses their pros and cons and the challenges with operating and regulating them. It ultimately seeks to examine whether the disclosure of information concerning the criminal history of one person to that person's intimate partner will ultimately increase the likelihood of keeping their partner safe. It speaks to academics working in the domestic violence / regulation/ criminal justice/ criminology fields as well as by policy makers in front line services and government agencies.

Book Domestic Violence Disclosure Scheme DVDS Pilot Assessment

Download or read book Domestic Violence Disclosure Scheme DVDS Pilot Assessment written by and published by . This book was released on 2013 with total page 26 pages. Available in PDF, EPUB and Kindle. Book excerpt: The coroner's report into the tragic case of Clare Wood, who was murdered by her former partner in Greater Manchester in 2009, recommended that "consideration should be given to the disclosure of such convictions and their circumstances to potential victims in order that they can make informed choices about matters affecting their safety and that of their children." Following public consultation, The Home Office trialled a one year pilot in 2012 in four police force areas - Gwent, Wiltshire, Greater Manchester and Nottinghamshire - to test a disclosure process within existing police legislative powers to share information and to ensure that appropriate risk assessments and safeguards are in place. It tested two processes: the 'Right to Ask', where a disclosure request is triggered by a member of the public directly contacting the police about a partner, and the 'Right to Know', where a disclosure request is triggered by police or partner agencies based on information that an individual is at risk of harm from their partner. This report sets out the findings from the assessment of the pilot. It investigated how the process was working in practice and the lessons for any wider adoption. The assessment was not designed to consider the impact on domestic abuse victims or the cost-effectiveness of the scheme.

Book Shades of Grey Domestic and Sexual Violence Against Women

Download or read book Shades of Grey Domestic and Sexual Violence Against Women written by Anna Carline and published by Routledge. This book was released on 2014-09-19 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: Arguing that law must be looked at holistically, this book investigates the ‘hidden gender’ of the so-called neutral or objective legal principles that structure the law addressing violence against women. Adopting an explicitly feminist perspective, it investigates how legal responses to violence against women presuppose, maintain and perpetuate a certain context that may not in fact reflect women’s experiences. Carline and Easteal draw upon relevant legislation, case law and secondary studies from a range of territories, including Australia, England and Wales, the United States, Canada and Europe, to contextualize and critique different policy responses. They go on to examine the potential and limits of law, making recommendations for best practice models of policymaking and law reform. Aiming to help improve government, community and legal responses to women who experience violence, Shades of Grey – Domestic and Sexual Violence Against Women: Law Reform and Society will assist law-makers, academics, policymakers and a wider audience in understanding the complexities of violence against women.

Book Criminalising Coercive Control

Download or read book Criminalising Coercive Control written by Vanessa Bettinson and published by Taylor & Francis. This book was released on 2023-08-07 with total page 75 pages. Available in PDF, EPUB and Kindle. Book excerpt: Drawing on experiences from other jurisdictions within the UK, Criminalising Coercive Control explores the challenges and potential successes which may be faced in implementing Northern Ireland’s new domestic abuse offence. A specific offence of domestic abuse was introduced in Northern Ireland in March 2021. This represents a crucial development in Northern Ireland’s response to domestic abuse. The new legislation has the effect of criminalising coercive and controlling behaviour, thereby bringing Northern Ireland into line with other jurisdictions within the UK, and also with relevant human rights standards in this regard. The book begins with a discussion regarding the offence itself and the underpinning domestic abuse policy in Northern Ireland. Subsequent chapters explore further measures which may be needed to respond effectively to domestic abuse in Northern Ireland, by drawing upon the experiences of other jurisdictions of criminalising coercive control. These reflections are considered through the lenses of policing, prosecutorial practice and frontline domestic abuse working. Criminalising Coercive Control will be of great interest to students and scholars in a variety of fields, such as criminal law, criminology, social policy, human rights, family law, gender studies and sociology. The book is also accessible beyond academia, including practitioners and those in the voluntary sector who are working in the area of combating domestic abuse.
