Book excerpt: Laws governing the criminal justice system's response to domestic violence have changed through the passage of mandated arrest and prosecution policies. However, while arrest rates for domestic violence increased throughout the 1990s and 2000s, these cases continue to receive lenient treatment by our courts. Most are resolved with dismissals. Currel-Dykeman explores if the court community literature can offer a possible explanation to this problem. She analyzes the local legal culture of two courts, a traditional court and a specialized problem solving court to understand how they discuss and process domestic violence cases differently. Court workgroup members were interviewed and candidly spoke about these cases in a way that helped explain the problem.

Because we were unable to identify with confidence cases referred to DV treatment, we identified a comparison group of non-DV cases and analyzed recidivism.

Book excerpt: Domestic Violence has consistently remained a crime that is controversial and difficult to combat. Previously under-acknowledged and misunderstood in early research, current studies and legislative reform have shifted a great deal of attention to this crime. This paper examined 624 cases of Intimate Partner Violence (IPV) that occurred in 2003 and were obtained through Charlotte Mecklenburg Police Department's (CMPD) computerized storage system, KBCOPS. This study examined incidence rates associated with assignment to the Domestic Violence (DV) Unit comprised of specialty policing unit and specialty court. This project assessed which individuals and cases were assigned to the unit, based upon personal demographic characteristics, previous domestic violence histories, and seriousness of the initial IPV case. The implementation of a specialty policing unit and specialized court, which are designed to handle the particular dynamics of domestic violence in Charlotte, appears to be successfully selecting and processing the most severe cases and dealing with individuals who may be considered high risk due to past experiences. While this project finds support that assignment to the DV Policing Unit is curbing IPV recidivism rates for offenders and re-victimization rates for victims, the desired impact of the specialty court is currently absent.

A chapter on the police role in domestic violence cases addresses written policies, the service call, arrest policy, the enforcement of protection orders, victim assistance, investigation, and training. A chapter with guidelines for prosecutors addresses the domestic violence unit, written policies, charge filing, pretrial release and diversion, plea bargaining, and victim support and protection. Another chapter covers trial procedures, sentencing options, and the role of probation officers following conviction. Other topics discussed are court-ordered counseling and education for batterers and community education and outreach. Appendixes contain various relevant materials from local criminal justice agencies.

Most restorative justice programs specifically exclude family violence as an appropriate offence to be dealt with this way. This book focuses on the issues in family violence that may warrant special caution about restorative justice, in particular, feminist and indigenous concerns. At the same time it looks for ways of designing a place for restorative interventions that respond to these concerns. Further, it asks whether there are ways that restorative processes can contribute to reducing and preventing family violence, to healing its survivors and to confronting the wellsprings of this violence. The book discusses the shortcomings of the present criminal justice response to family violence. It suggests that these shortcomings require us to explore other ways of addressing this apparently intractable problem.
