Latinas face multiple barriers because of their race, national origin, and gender, affecting how they experience and respond to domestic violence. This Article examines the various factors that are unique to the political, social an economic status of Latinas, drawing on statistics, demographic data, common representations and caricatures of Latinas and Latinos, and Latinas' own descriptions of violence. The Article employs critical race feminism to critique the most significant efforts currently within the legal and social service sectors to assist battered women. It challenges legislators and law enforcement officials to consider the different experiences and realities of women of color when designing effective law enforcement for violence between intimate partners, and to implement social service programs that meet the specific needs of battered Latina women. Language barriers and the historical experiences of Latinos and Latinas in the United States and recent immigrants' experiences in their countries of national origin, are also discussed as important considerations for designing legislative and judicial responses to interpersonal violence in the Latino community.

Book excerpt: According to the 2000 Census, Latinos accounted for 12.5% of the US population, or 35.3 million residents-the fastest growing population in the United States. The influence of this large and growing demographic can be seen throughout every academic discipline in the numerous books, journals, and societies on multicultural assessment, counseling, and research that have begun to appear. However, one area of inquiry remains largely unexplored; domestic violence within Latino families. Although it appears that such violence occurs as frequently in Latino families as in Caucasian families, little research has been done on this topic and very few counseling programs explicitly developed for Latino families currently exist. Healing from Violence fills this void. Drawing on a research study of 150 Latino men who completed a year of court-ordered treatment in Southern California, and a four-year pilot study, the authors mix quantitative and qualitative methodology in order to provide counselors with an opportunity to hear first-hand how Latino partner abusive men think about manhood (machismo), interpersonal relationships, (respeto, personalismo, and simpatÌa), and family life (familismo). The authors then use these in-depth portraits to guide counselors in tailoring treatment plans to the specific needs of Latino men. Voices from Healing From Violence: "How should a Mexican man be? Book excerpt: A man murders his wife after she has admitted her infidelity; another man kills an openly gay teammate after receiving a massage; a third man, white, goes for a jog in a “bad” neighborhood, carrying a pistol, and shoots an African American teenager who had his hands in his pockets. When brought before the criminal justice system, all three men argue that they should be found “not guilty”; the first two use the defense of provocation, while the third argues he used his gun in self-defense. Drawing upon these and similar cases, Cynthia Lee shows how two well-established, traditional criminal law defenses—the doctrines of provocation and self-defense—enable majority-culture defendants to justify their acts of violence. While the reasonableness requirement, inherent in both defenses, is designed to allow community input and provide greater flexibility in legal decision-making, the requirement also allows majority-culture defendants to rely on dominant social norms, such as masculinity, heterosexuality, and race (i.e., racial stereotypes), to bolster their claims of reasonableness. At the same time, Lee examines other cases that demonstrate that the reasonableness requirement tends to exclude the perspectives of minorities, such as heterosexual women, gays and lesbians, and persons of color. Murder and the Reasonable Man not only shows how largely invisible social norms and beliefs influence the outcomes of certain criminal cases, but goes further, suggesting three tentative legal reforms to address problems of bias and undue leniency. Ultimately, Lee cautions that the true solution lies in a change in social attitudes.
