Not all of these criminals have been prosecuted under terrorism statutes. This latter point is not meant to imply that domestic terrorists should be taken any less seriously than other terrorists. The Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) do not officially list domestic terrorist organizations, but they have openly delineated domestic terrorist "threats." These include individuals who commit crimes in the name of ideologies supporting animal rights, environmental rights, anarchism, white supremacy, anti-government ideals, black separatism, and anti-abortion beliefs. Five discussion topics in this report may help explain domestic terrorism's significance for policymakers: 1) Level of Activity. Domestic terrorists have been responsible for orchestrating more than two-dozen incidents since 9/11, and there appears to be a growth in anti-government extremist activity as measured by watchdog groups in the last several years. 2) Use of Nontraditional Tactics. A large number of domestic terrorists do not necessarily use tactics such as suicide bombings or airplane hijackings. 3) Exploitation of the Internet. Domestic terrorists--much like their jihadist analogues--are often Internet savvy and use the medium as a resource for their operations. 4) Decentralized Nature of the Threat. Many domestic terrorists rely on the concept of leaderless resistance. This involves two levels of activity. On an operational level, militant, underground, ideologically motivated cells or individuals engage in illegal activity without any participation in or direction from an organization that maintains traditional leadership positions and membership rosters. On another level, the above-ground public face (the "political wing") of a domestic terrorist movement may focus on propaganda and the dissemination of ideology--engaging in protected speech. 5) Prison Radicalization. Prison has been highlighted as an arena in which terrorist radicalization can occur. Some prison gangs delve into radical or extremist ideologies that motivate domestic terrorists, and in a number of instances, these ideologies are integral to fashioning cohesive group identities within prison walls. It must be reiterated, however, that even for gangs that exhibit these ideological dimensions, criminal enterprises such as drug trafficking--not radical beliefs--largely drive their activities.

As this report shows, the acceleration of domestic extremism poses a number of serious considerations for U.S. policymakers and officials in charge of counterterrorism and homeland security. Given the United States' largely effective post-9/11 efforts to prevent foreign terrorist infiltration, these sorts of homegrown recruits may represent the best chance for al Qaeda and other global terrorist organizations to launch a major attack in the United States. Of course, would-be domestic extremists need not acquire training abroad to inflict substantial harm at home, as the Fort Hood shootings revealed. The threats posed by homegrown extremism, then -- even if not widespread -- demand a close examination.

The first chapter discusses how domestic terrorists broadly fit into the counterterrorism landscape, a terrain that since 9/11 has been largely shaped in response to terrorists inspired by foreign ideologies. This chapter focuses especially on how domestic terrorism is conceptualized by the federal government and issues involved in assessing this threat's significance. Recent events of domestic terrorism which have been either perpetrated by active duty United States military personnel, or have been indirectly linked to active duty and ex-military persons, have caused significant concern and alarm over the extent to which extremists and hate-groups are present in the military services. The Rise of Domestic Terrorism and Its Relation to United States Armed Forces is discussed in chapter 2. In light of the violence related to protests in Charlottesville, VA, on August 12, 2017, policymakers may be interested in how the concepts of domestic terrorism, hate crime, and homegrown violent extremism compare with one another as described in chapter 3. They are fairly distinct ideas that federal law enforcement agencies use to categorize key types of criminals whose illegal activities are at least partly ideologically motivated. November 1998 the FBI activated NICS for the purposes of determining an individual's firearms transfer and possession eligibility whenever an unlicensed individual seeks to acquire a firearm from a federally licensed gun dealer. Federal law enumerates several grounds that disqualify someone from firearms eligibility. However, being a known or suspected terrorist is not a federal firearms eligibility disqualifier as reported in chapter 4.

It is ridiculously easy for a single person with a bomb-filled backpack, or a single explosives-laden automobile, to launch an attack. So why hasn't it happened? The answer is surely not the Department of Homeland Security, which cannot stop terrorists from entering the country, legally or otherwise. It is surely not the Iraq war, which has stoked the hatred of Muslim extremists around the world and wasted many thousands of lives. Terrorist attacks have been regular events for many years -- usually killing handfuls of people, occasionally more than that. Is it possible that there is a simple explanation for the peaceful American homefront? Is it possible that there are no al-Qaeda terrorists here? Is it possible that the war on terror has been a radical overreaction to a rare event? Consider: 80,000 Arab and Muslim immigrants have been subjected to fingerprinting and registration, and more than 5,000 foreign nationals have been imprisoned -- yet there has not been a single conviction for a terrorist crime in America. A handful of plots -- some deadly, some intercepted -- have plagued Europe and elsewhere, and even so, the death toll has been modest. We have gone to war in two countries and killed tens of thousands of people. We have launched a massive domestic wiretapping program and created vast databases of information once considered private. Politicians and pundits have berated us about national security and patriotic duty, while encroaching our freedoms and sending thousands of young men off to die. It is time to consider the hypothesis that dare not speak its name: we have wildly overreacted. Terrorism has been used by murderous groups for many decades, yet even including 9/11, the odds of an American being killed by international terrorism are microscopic. In general, international terrorism doesn't do much damage when considered in almost any reasonable context. The capacity of al-Qaeda or of any similar group to do damage in the United States pales in comparison to the capacity other dedicated enemies, particularly international Communism, have possessed in the past. Lashing out at the terrorist threat is frequently an exercise in self-flagellation because it is usually more expensive than the terrorist attack itself and because it gives the terrorists exactly what they are looking for. Much, probably most, of the money and effort expended on counterterrorism since 2001 (and before, for that matter) has been wasted. The terrorism industry and its allies in the White House and Congress have preyed on our fears and caused enormous damage. It is time to rethink the entire enterprise and spend much smaller amounts on only those things that do matter: intelligence, law enforcement, and disruption of radical groups overseas. Above all, it is time to stop playing into the terrorists' hands, by fear-mongering and helping spread terror itself.
