La obra de "Rómulo y Remo", "La Monarquía", "La República, "El Imperio" (sus emperadores y su ocaso); cómo surge el "Derecho Romano", y "el uso del latín en el derecho". Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.

Book excerpt: The book provides rule-by-rule commentaries on European contract law (general contract law, consumer contract law, the law of sale and related services), dealing with its modern manifestations as well as its historical and comparative foundations. After the collapse of the European Commission's plans to codify European contract law it is timely to reflect on what has been achieved over the past three to four decades, and for an assessment of the current situation. In particular, the production of a bewildering number of reference texts has contributed to a complex picture of European contract laws rather than a European contract law. The present book adopts a broad perspective and an integrative approach. All relevant reference texts (from the CISG to the Draft Common European Sales Law) are critically examined and compared with each other. As far as the acquis commun (ie the traditional private law as laid down in the national codifications) is concerned, the Principles of European Contract Law have been chosen as a point of departure. The rules contained in that document have, however, been complemented with some chapters, sections, and individual provisions drawn from other sources, primarily in order to account for the quickly growing acquis communautaire in the field of consumer contract law. In addition, the book ties the discussion concerning the reference texts back to the pertinent historical and comparative background; and it thus investigates whether, and to what extent, these texts can be taken to be genuinely European in nature, ie to constitute a manifestation of a common core of European contract law. Where this is not the case, the question is asked whether, and for what reasons, they should be seen as points of departure for the further development of European contract law.

Book excerpt: La obra ofrece una solución respecto del tratamiento que ha de recibir el error del autor en aquellos supuestos en los que el legislador remite a disposiciones jurídicas recogidas en otros sectores del ordenamiento, resultando el contenido de tales disposiciones necesario para conocer el supuesto de hecho típico. Se trata de una cuestión ampliamente abordada, muy controvertida, de enorme trascendencia práctica -sobre todo en el ámbito del derecho penal accesorio- y que presenta un alto nivel de abstracción, lo que ha llevado a estructurar el trabajo en torno a tres casos particulares que constituyen su hilo conductor. Las extraordinarias dificultades que se plantean a la hora de delimitar entre los diferentes contenidos de conciencia contemplados por doctrina y jurisprudencia en materia de error -tipo, prohibición, circunstancias fácticas, derecho penal, derecho extrapenal-, unidas a la revisión del concepto de dolo tradicional, se traducen en una original propuesta de delimitación entre los errores que excluyen el dolo y los que no tienen ese efecto. Esta solución se ve acompañada de una propuesta de interpretación de la regulación legal en el marco de diferentes ordenamientos, particularmente europeos y latinoamericanos.

Based on pan-European comparative research which annotates the work, this volume presents model rules on liability. Explanatory comments and illustrations amplify the policy decisions involved. During the drafting process, comparative material from over 25 different EU jurisdictions has been taken into account. The work therefore is not only a presentation of a future model for European rules to come but provides also a fairly detailed indication of the present legal situation in the Member States.
