Book excerpt: The article attempts to answer the above question because the social market economy, prima facie one of many objectives set out in Article 3 of the TEU, is above all else an integrated social model, a collection of other objectives, and a concept that ranks other objects in a systematic whole. Reaching this aim requires adequate competencies. The article takes 10 main parts of the social market economy content as analysed by current doctrine and compares it with the list of EU competencies as listed in the founding treaties. Through this detailed analysis it comes to the conclusion that although EU competencies are relevant for the majority of social market economy content, the more a particular problem relating to social market economy approaches significant aspects of the functioning of the state, the smaller the impact of the EU and its competences.

Book excerpt: In this article we take managing migration and managing the gig economy as a prism through which to examine not only whether the phrase 'social market economy' has any real substance, but also whether it offers any guidance as to how the European Union (EU) may respond in the future. We argue that the language of 'social market economy', a concept drafted in the halcyon days prior to the financial and migration crises, serves only to highlight the gap between rhetoric and reality. We identify two main reasons for this, namely a lack of legal competence and a lack of political will. We then consider whether the objective of attaining a 'social market economy' can be operationalised in any way. In the light of the establishment of the European Social Pillar, we argue that it can, yet within certain limits. We conclude by arguing that the lack of clear communication by the EU, both of its successes and also of the limits on its powers, means that it receives little credit for the good it is able to do. It also unnecessarily raises expectations among the public about what it can achieve. This inevitably leads to the disappointment generated by unfulfilled expectations.

Book excerpt: "This monograph, which was also designed as a short reference book for specialized undergraduate and graduate courses on EU law, intends to shed light on, and legally frame, the evolution of the doctrine of services of general economic interest (SGEIs). The book emphasizes the pivotal role played by SGEIs in striking a fair balance between market and social objectives. To this end, the book claims, first of all, that SGEIs have a dual nature inasmuch as they act as a limitation to/derogation from the free market and, simultaneously, as a value and positive obligation addressed at national authorities, undertakings, and EU institutions. The EU notions of access to public services and universal service are the clearest signal of such phenomenon. Secondly, the book claims that the transfer of competences from the Union to the Member States and the reaffirmation of Member States' sovereignty in crucial sectors of the economy are not the only solutions to foster social rights. In fact, this narrative is apt to undermine the foundations, spirit, and purpose of the process of European integration, especially at a time like the present, when new forms of populism and anti-Europeanism are on the rise, and when a European response is imperative to counter the spread of the coronavirus in European countries. The book concludes that SGEIs' regulation is an area of law where the EU institutions have generally successfully put into action and consolidated the social market economy principles on which the EU was founded. This is even further proof that the EU is not merely the reflection of interests linked to market completion, but also and foremost a 'Community based on the rule of law'. Book excerpt: From the entry into force of the Lisbon Treaty the EU has among its constitutional objectives the goal of achieving a highly competitive social market economy. At the same time, however, the EU has not been given any specific powers to actively develop its social policy. After six years of legal force of the Lisbon Treaty there is still no clarity on how should the EU interpret the legacy of German post-war Sozialmarktwirtschaft, whether it should strive for its own economic and social “Constitution”, whether it can try to fulfil the objective of social market economy through the instruments of EU law. The paper argues that some, rather partial, measures enacted by the EU legislator would be desirable and feasible without creating a danger of over-regulation that would threaten the freedoms of the internal market or distort the existing division of powers between the EU and the Member States in the social field. The social market economy concept, being itself a compromise between the free markets and social welfare requirements, can act there as a guarantee that neither unbounded market freedoms nor socializing policies would dominate the EU.

Book excerpt: The term 'social market economy' was introduced in the Treaty on European Union in order to emphasise that social and economic objectives of the European Union are both important, and have to be reconciled with each other. This contribution describes how social objectives have been developed in EU law since the establishment of the European Economic Community. The Court of Justice of the European Union has interpreted Treaty provisions to give them maximum effect for the realization of these objectives. However, tensions with the economic objectives exist when economic freedoms are confronted with social rights. This contribution examines how the CJEU balances these interests, and how this relates to the social market economy. There are also areas where economic rights have no counterpart at the EU level, but where they interact with social policies of Member States. Here too, the concept of social market economy is relevant. After a discussion of these various dimensions of the term social market economy, the subsequent articles of this Special Issue are introduced.

Unlike the existing differentiation by means of opt-outs and deviations, variation is not a concession intended to resolve impasses in negotiations; it is, rather, a different structuring principle. It takes differences in needs and in democratically supported convictions seriously. A common core remains necessary, specifically concerning the basic principles of democracy, rule of law, fundamental rights and freedoms, and the common market. By taking this approach, the authors remove the pressure to embrace uniformity from the debate about the EU’s future. The book discusses forms of variation that fall both within and outside the current framework of European Union Treaties. The scope for these variations is mapped out in three domains: the internal market; the euro; and asylum, migration and border control.

But since 1995 EU law and European law perspectives have been extensively integrated into existing Swedish labour and social security law, and the chapters in this book go a long way in illustrating the far-reaching and multifaceted ways in which Swedish law has been 'Europeanised'.
