This book was released on 1977 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: At its twenty-ninth session, the General Assembly, in Resolution 3272 (XXIX) on the elaboration of a draft Convention on Territorial Asylum, decided to establish a Group of Experts on the Draft Convention on Territorial Asylum. The Group of Experts met in 1975 to review the text of a draft Convention on Territorial Asylum. This Report of the 1977 United Nations Conference on Territorial Asylum contains the recommendation of the Conference that the General Assembly of the United Nations at its thirty-second session consider the question of convening at an appropriate time a further session of the Conference since the Conference was unable to carry out its mandate concerning the draft Convention within the allocated time. The major annex to the Report is the Report of the Committee of the Whole. The Report of the Committee of the Whole has an introduction describing its activities. Section II of the Report deals with each proposed or existing new article of the draft Convention in separate subsections. The subsections deal with: Article I (grant of asylum), Article 2 (application), new article on the question of activities of asylees, new article on the question of family reunion, Article 3 (non-refoulement). Each subsection of Section II first sets out the text as proposed by the Group of Experts or the text (or texts) of a proposed new article. It then lists the texts of relevant amendments with an indication of the manner in which they were disposed of. It finally describes the proceedings of the Committee of the Whole. The text of articles and amendments submitted up to that point which had not yet been considered by the Committee are reproduced in an appendix to the Report of the Committee. A Note by the Secretary-General to the Conference refers to a select bibliography on territorial asylum which is contained in the documents to the Conference.

Book Mass Refugee Influx and the Limits of Public International Law

Download or read book Mass Refugee Influx and the Limits of Public International Law written by Ann Vibeke Eggli and published by BRILL. This book was released on 2021-11-15 with total page 343 pages. Available in PDF, EPUB and Kindle. Book excerpt: Situations of mass refugee influx represent by their very size and urgency daunting evidence of human suffering and cruelty. Consequently, the level and quality of refugee protection in times of crisis is tested. The choices to be made have to take into due consideration the prevalent conditions and restraints. They will probably always result in compromises. The question is whom or what the compromises are about? The focus in the present volume has been set on a detailed examination of some legal preconceptions commonly found in situations of mass refugee in-migration. The author concludes that situations when refugees arrive en masse do not, as a rule, qualify as a public emergency that threatens the life of the nation under contemporary international human rights law, and that mass expulsion of refugees as an emergency measure is prohibited at all times when this entails the risk of violating rights immune to derogation.

Book The United Nations Rule of Law Indicators

Book excerpt: "Building and strengthening the 'rule of law' in developing nations, particularly countries in transition or emerging from a period of armed conflict, has become a central focus of the work of the United Nations. As a result, there is a growing demand throughout the United Nations system to better understand the delivery of justice in conflict and post-conflict situations and the impact of developments in this area. The United Nations Department of Peacekeeping Operations (DPKO) and the Office of the United Nations High Commissioner for Human Rights (OHCHR), in cooperation with other United Nations departments, agencies, funds and programmes, have developed an instrument to monitor changes in the performance and fundamental characteristics of criminal justice institutions in conflict and post-conflict situations. The instrument consists of a set of indicators, the United Nations Rule of Law indicators. This guide describes how to implement this instrument and measure these indicators"--P. v.

Book The Arc of Protection

Download or read book The Arc of Protection written by T. Alexander Aleinikoff and published by Stanford University Press. This book was released on 2019-10-01 with total page 129 pages. Available in PDF, EPUB and Kindle. Book excerpt: The international refugee regime is fundamentally broken. Designed in the wake of World War II to provide protection and assistance, the system is unable to address the record numbers of persons displaced by conflict and violence today. States have put up fences and adopted policies to deny, deter, and detain asylum seekers. People recognized as refugees are routinely denied rights guaranteed by international law. The results are dismal for the millions of refugees around the world who are left with slender prospects to rebuild their lives or contribute to host communities. T. Alexander Aleinikoff and Leah Zamore lay bare the underlying global crisis of responsibility. The Arc of Protection adopts a revisionist and critical perspective that examines the original premises of the international refugee regime. Aleinikoff and Zamore identify compromises at the founding of the system that attempted to balance humanitarian ideals and sovereign control of their borders by states. This book offers a way out of the current international morass through refocusing on responsibility-sharing, seeing the humanitarian-development divide in a new light, and putting refugee rights front and center.
