Book excerpt: Excerpt from Documents Illustrative of International Law There are in existence several books of cases, dealing with the Law of Nations as a whole or with separate parts of it. Most of them are excellent, and nothing was further from my thoughts in compiling the present work than to enter into com petition with them. What I have endeavoured to do is to pro duce a book which shall contain, not merely judgments and opinions given in connection with disputes brought before Courts for settlement, but documents of all kinds which bear on the formation and development of the rules of International Law. The student reads in his text-books that certain authors who wrote some three centuries ago made such a deep impres sion on the collective mind of Western Europe that the principles most of them advocated became the foundations of a science of international relations unlike anything that had gone before it, though borrowing much from previously existing theories and institutions. I have given him extracts from some of the most distinguished of these writers, that he may see for himself how, and against what, they reasoned. He also reads that in modern times states have begun to settle for themselves by common agreement what rules they will obey in many depart ments of their mutual intercourse. I have placed before him all the great law-making documents in which these agreements are recorded. Further, he learns that in the interval between the great J urists who watched over and controlled the infancy of International Law, and the great Conferences which have moulded its newest activities, treaties, judgments of prize-courts and arbitral tribunals, state-papers of all kinds, and even the Opinions of private persons or associations of persons, influenced its development, and are likely still to do so, some of them in a more marked degree than before. I have not relegated important matter to notes, nor printed on my pages long quotations from other authors or excerpts from original authorities. I have preferred the much more labo rions task of extracting their substance and putting it in my own words into the body of the book, which I trust has gained thereby in both the decrease of bulk and increase of readableness. But I have taken care to provide the means of checking my assertions. At the bottom of nearly every page will be found references, by the use of which teachers and students can amplify or correct the statements in the text and men of aflairs obtain the more detailed information they may want for practical purposes. The notes are, I h0pe, sufficient. My object has been to make them adequate without over loading them with matter. I have not, for instance, referred to a large number of writers of all degrees of authority, when the citation of a few great ones gave the necessary support to my argument; nor have I quoted a dozen cases, when one or two were enough. International sovereignty and rights are the growth of recent centuries, and the very object of our science is to ascertain the point at which they now stand. Some of the earlier stages of that growth were assisted by theories of a law of nature and nations, of which what is good survives under the name of justice, a ground more solid but less capable of being systematised, while the attempt to transfer wholesale to associa tions what is true of natural individuals was bound to fail.
