Book excerpt: Il diritto romano è, e rimarrà, un monumento alla capacità della mente di inquadrare i comportamenti sociali dell'uomo in schemi razionali. Il distillato di quest'opera dei giuristi antichi, da quelli romani ai glossatori, ai commentatori delle università italiane del Rinascimento, ci è dato dalle regulae iuris, dai brocardi, dai proverbi giuridici che, in larga parte, sono dedicati proprio a sintetizzare queste regole in frasi di semplice comprensione e memorizzazione, che rappresentano un patrimonio culturale anche per i giuristi di oggi. In genere, oltre ad indici analitici basati sull'istituto giuridico a cui la massima è riferibile, si è indicato il dato normativo moderno a cui la massima potrebbe ancora essere applicata. La soluzione più ovvia sarebbe di inserire le massime in un computer e di affidarsi alla ricerca elettronica attraverso le parole del testo, italiane e latine, e attraverso classificazioni sistematiche. Considerando però che la diffusione dei mezzi informatici presenta ancora dei limiti, ho preferito seguire il sistema tradizionale dell'indice analitico molto curato in cui le massime sono rintracciabili in base alle parole od alle associazioni di idee che userebbe un giurista. Ho quindi qui raccolto, attraverso un'accurata selezione, che in questa edizione è stata significativamente ampliata, oltre 2900 tra proverbi giuridici latini, brocardi, regulae juris, definizioni giuridiche; ad essi ho aggiunto 2100 vocaboli o espressioni del diritto romano nonchè modi di dire latini e frasi celebri che ho ritenuto potessero essere egualmente di qualche interesse per il giurista che deve leggere un testo con citazioni in latino o per chi, più semplicemente, ricerca una citazione ad hoc da inserire in un testo o in un discorso. Nello scegliere i proverbi e le definizioni giuridiche ho seguito un duplice criterio: in primo luogo che essi avessero quelle caratteristiche di lapidarietà e di sinteticità che, per l'appunto, fanno distinguere un proverbio da una normale affermazione; in secondo luogo che essi fossero ancora di interesse attuale per lo studente di diritto o per il giurista. Ogni voce è stata tradotta in modo da rendere più chiaro possibile il suo significato e da limitare quindi al massimo ogni spiegazione; quando questa è stata indispensabile, l'ho formulata in modo sintetico. L'esigenza di chiarezza ha fatto sì che la traduzione sia talvolta letterale, talvolta libera. Per ragioni derivanti dall'elaborazione elettronica l'ordine alfabetico non è sempre quello tradizionale, ma è basato esclusivamente sulla prima parola, anche se questa è una congiunzione o una preposizione. Sento il dovere di precisare, con la massima chiarezza, che circa 1600 dei brocardi qui riportati sono stati tratti dall'opera di DETLEF LIEBS, citata in bibliografia, a cui quindi va tutto il merito della selezione e ricerca dei testi originali che io ho provveduto a tradurre e ad integrare con altre fonti. In appendice riporto il testo latino delle XII Tavole con una moderna traduzione in lingua italiana, di sicuro interesse per gli studiosi del diritto romano.
