[...] I hope and believe that this report will assist you and your colleagues to modernize Part III of the Canada Labour Code, to address some of the difficult issues confronting workers and employers in the federal domain and to ensure that the Labour Program, custodian of Part III, is able to contribute to broader public policy discussions which touch on the matters under review. [...] Part III and human rights • In order to ensure full implementation of both human rights and labour standards, and to make the best use of available resources, the Labour Program and the Canadian Human Rights Commission xii should enter into formal cooperation agreements in order to avoid conflicts and overlaps between the two regimes. [...] And not a few depend ultimately on the willingness of all of us to rethink our attitudes to work, to personal relationships and to what it means to be individual and corpo- rate citizens of a community that is committed to fairness and decency. [...] Accordingly, factory and mine "inspectors" were given the power to enter premises, to require the pro- duction of records, to compel the adoption of safe equipment and detailed working rules, to determine whether violations had occurred, to make remedial and stop-work orders, to impose fines, and to conduct prosecutions of serious offences.

The task force mandate was to identify options and, where appropriate, make recommendations for legislative change, with a view to improving collective bargaining and reducing conflict, facilitating labour-management co-operation, ensuring effective and efficient administration of the Code, and addressing the changing workplace and employment relationship. Task force work included public consultations, receipt of written submissions, informal meetings with interested groups, and academic round tables. Section I of the report introduces the review, the legal framework of federal labour legislation, the new labour relations environment, and considerations for reform. Section II covers issues related to the labour relations process, including the scope of collective bargaining, representation processes, rights and obligations during a strike or lockout, and essential services. Section III covers Code administration issues, including the powers and structure of the Canada Labour Relations Board, mediation and conciliation services, and the arbitration process. The final section discusses wider labour-relations options available that go beyond part I of the Code.

Book excerpt: Part III of the Canada Labour Code (the federal labour standards) applies to enterprises under federal jurisdiction and provides a regulatory framework for conditions of work. This report presents findings of the second phase of an evaluation of Part III, which involved a review of the literature, interviews with key stakeholders & experts, and two major exploratory surveys of employers & workers. The overall purpose of this phase was to gather information to identify considerations for the Labour Program of Human Resources Development Canada (which administers services & enforcement activities carried out in relation to labour standards contained in the Code) with a view to keeping Part III in tune with social change and the changing nature of work. The report assesses the implications for Part III of a variety of factors in the changing world of work and non-standard work. The report also examines the following additional issues: federal labour standards as they affect First Nations in Canada; issues in Part II of the Code relating to occupational health & safety and its possible linkage to Part III, as well as the need for a broader evaluation of Part II; education, information, & compliance; and a possible third phase in the evaluation of Part III.

[...] The sacrifices being made may well undermine the short- and long-term well-being of Canadian workers and society as a whole." Women in the Workforce: Implications for Part III Issues relating to work-family conflict - above all promoting more flexibility for workers in terms of working time over the working week and the life-course - should be a major priority in the review of Part III. [...] In its submission to the Canadian Human Rights Act Review Panel in 1999, the CLC proposed that the establishment of Human Rights Workplace Committees be required, on the model of the health and safety committees required in Part II of the Code.
