Book excerpt: As governments are major buyers of goods and services, foreign companies are keen to be able to participate in procurement opportunities on an equal footing with national firms. This has given rise to the inclusion of procurement disciplines in trade agreements and to internationally-agreed good regulatory practices in this important policy area. The contributions to this book examine how the dynamic mix of bilateral, regional, plurilateral and international norms on government procurement is reflected in purchasing practices at the national level and whether these are leading to convergence in policies and approaches. The countries studied span both advanced, high-income economies and emerging economies. Some are members of the WTO procurement agreement, others are not. Most WTO members have decided not to commit to binding international disciplines on procurement in trade agreements. This book explores whether there has been nonetheless internationalization of good procurement practices, and what current public purchasing processes suggest as regards the value added of signing on to binding rules of the game in this area. The approach taken in the volume is interdisciplinary. Contributors include economists, political scientists, legal scholars, and practitioners with a solid understanding of both the extant international disciplines and national government procurement policies. Each chapter assesses the current state of play as regards legislation and procurement practices; the degree to which industrial policy considerations feature in the relevant regulatory frameworks; the existence and use of domestic dispute resolution and review procedures that allow firms to contest the behavior of procuring entities; and the availability of data on procurement processes and outcomes.

Book excerpt: Abstract: A number of countries used discriminatory government procurement policies as part of stimulus packages designed to alleviate the effects of the global economic crisis. This paper collates and updates the evidence related to the size of procurement markets, the level of home bias they exhibit, and the effectiveness of multilateral and bilateral procurement agreements in reducing that bias. The share of procurement in GDP has been increasing gradually since 1995 with clear spikes during 2000-2002 and 2008-2010, the latter in response to the global economic crisis. The analysis presents evidence of domestic bias in government procurement markets, bias which has been increasing over recent years. The analysis in this paper suggests that the results of international efforts to address home bias in government procurement have been mixed to date. The World Trade Organisation's Government Procurement Agreement (GPA) is found to reduce discrimination in procurement markets, although available -- but limited -- evidence does not indicate a significant effect for bilateral agreements. The evidence suggests liberalisation of investment barriers undertaken in parallel with trade agreements increases the ability of those agreements to reduce discrimination. This suggests that countries negotiating procurement agreements could also benefit from negotiating investment agreements in parallel

Book excerpt: Pursuant to a congressional request, GAO assessed the implementation of Title VII of the Omnibus Trade and Competitiveness Act of 1988, focusing on the: (1) availability and adequacy of information to the President about foreign discriminatory procurement; and (2) U.S. government's efforts to gather the information. GAO found that: (1) the President's first report identifying countries that discriminated against U.S. companies in their government procurement practices was due April 30, 1990; (2) the U.S. Trade Representative's investigations were seeking detailed information on the procurement procedures and practices of many countries which sold little to the U.S. government, in some cases less than $100,000; (3) due to unchanged monitoring codes, the 1990 Title VII investigation will be based on some information that is over 2 years old; (4) the private sector had not come forward with many complaints; and (5) due to a lack of expertise and resources, the government's ability to obtain information about foreign government procurement has been limited.

Book excerpt: Government policy makers have been confronted with requests by various lobbying groups to “level the playing field” for Free and Open Source Software (FOSS) developers through policies that would remove the ability of patent holders to seek royalties for the use of their technologies in standards. These groups have made claims that the Fair Reasonable and Non Discriminatory (FRAND) licensing framework that is used in most standards setting organizations (SSOs), and which allows for the inclusion of a royalty term, are incompatible with or discriminate against FOSS developers. Part I takes closer look at these claims, as well as the current market for ICT products (those covered by a FOSS license, those covered by traditional commercial licenses and those hybrid products covered by both) and finds that there is no evidence that FOSS developers are unable to implement the wide range of standards that are currently covered by FRAND commitments. Part II looks at the recent work of several commentators who have examined this issue in a detailed and empirical manner and have found not just that the claims of exclusion by FRAND (and patent royalties in particular) are exaggerated, but that there are documented instances of the successful interplay between FRAND terms (including royalties) and FOSS licenses (even the GPL). The paper concludes that absent evidence of market failure, government procurement officers should leave it to market participants to work out agreements that allow standards subject to FRAND commitments and FOSS licensed products to co-exist as they do today. The current IP licensing framework (including the possibility of a royalty) effectively balances the rights of innovators and the interests of implementers of all business models, resulting in compelling products for consumers at competitive prices.

Book excerpt: It has been clear for at least 50 years the disadvantages that small businesses face in competing for U.S. government contracts. The Small Business Act of 1953 created the Small Business Administration (SBA), an independent agency in the executive branch that counsels and assists specific types of small businesses including firms owned by minorities and other socially and economically disadvantaged individuals and firms owned by women. Women-owned small businesses, however, are underrepresented or substantially underrepresented in some industries. In 2002, the SBA Office of Federal Contract Assistance for Women Business Owners (CAWBO) organized a draft study containing a preliminary set of approximations of the representation of women-owned small businesses in federal prime contracts over $25,000 by industry. Because of the past legal challenges to race- and gender-conscious contracting programs at the federal and local levels, the SBA asked the Committee on National Statistics of the National Academies to conduct an independent review of relevant data and estimation methods prior to finalizing the CAWBO study. The Steering Committee on Women-Owned Small Businesses in Federal Contracting was created and charged with holding a workshop to discuss topics including the accuracy of data and methods to estimate the use of women-owned small businesses in federal contracting and the definition of "underrepresentation" and "substantial underrepresentation" in designating industries for which preferential contracting programs might be warranted. Analyzing Information on Women-Owned Small Businesses in Federal Contracting presents the committee's report as well as the recommendations that committees have made.
