Book Child Rights and International Discrimination Law

Download or read book Child Rights and International Discrimination Law written by Marit Skivenes and published by . This book was released on 2019 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Societies and states are at a crossroad in how children are treated and how their rights are respected and protected. Children ́s new position and their strong rights create tensions and challenge the traditional relationships between family and the state. The United Nations Convention on the Rights of the Child was adopted unanimously by the General Assembly of the United Nations in 1989 and came into force in 1990. Article 2 places states under an obligation to accord primacy to the best interests of the child in all actions concerning children and to ensure and regulate child protection. This book offers a comparative and critical analysis of the implementation of Article 2 of the United Nations Convention on the Rights of the Child. In order to examine how Article 2 is being implemented, it is essential to have a sound understanding of the obligations it emposes. The opening chapters will explore the precise content of these obligations in terms of the legislative history of the text, its underlying philosophy, its amplification by the United Nations Committee on the Rights of the Child, and subsequent authoritative interpretations of it by courts around the world. The book will then drill down into the conceptual and theoretical challenges posed by the very nature of the obligations and will offer in-depth exploration of the long-running 'rights v welfare' debate that has always presented something of a challenge in giving effect to children's rights. Contributors are leading academics in the children's rights field drawn from a wide range of countries and jurisdictions worldwide, including those with common law, civilian and mixed traditions. Disciplines represented in the book include law, psychology, political science, childhood studies, social work and anthropology. By drawing together the various facets of Article 2 and analysing it from a range of perspectives, the volume provides a coherent and comprehensive inter-disciplinary analysis on discrimination and the rights of the child.

Book Endangered Daughters

Download or read book Endangered Daughters written by Elizabeth Croll and published by Routledge. This book was released on 2002-01-04 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: This unique and groundbreaking book seeks to re-focus gender debate onto the issue of daughter discrimination - a phenomenon still hidden and unacknowledged across the world. It asks the controversial question of why millions of girls do not appear to be surviving to adulthood in contemporary Asia. In the first major study available of this emotive and sensitive issue, Elisabeth Croll investigates the extent of discrimination against female children in Asia and shifts the focus of attention firmly from son-preference to daughter-discrimination. This book brings together demographic data and anthropological field studies to reveal the multiple ways in which girls are disadvantaged, from excessive child mortality to the withholding of health care and education on the basis of gender. Focusing especially on China and India, the book reveals the surprising coincidence of increasing daughter discrimination with rising economic development, declining fertility and the generally improved status of women in East and South Asia. Essential reading for all those interested in gender in contemporary society.

Download or read book Loved and Unloved written by Jasodhara Bagchi and published by Stree Distributed by Bhatkal Books International. This book was released on 1997 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why does this book speak of the girl child and not of the child, whether boy or girl? The girl child is the endangered sex in our society. She remains entrapped in a complex social process that 'naturalises' her deprivation. Her place is within the family which traditionally has been viewed as a specially nurturing and protecting institution for her. Critically examining this view, the authors raise vital questions on gender-based discrimination within the family. Thirteen case studies poignantly reveal the way discrimination occurs. The authors have used the data for West Bengal compiled by the School of Women's Studies, Jadavpur University, as part of the national project on the girl child that was sponsored by the Indian government and carried out in twenty two women's studies centres. The book surveys 600 sample households, covering girls aged 7-18 years in selected rural and urban areas. It offers detailed analysis of the girl child's mother and her perceptions of her children; her daughters in particular.

It is free to read at Oxford Scholarship Online and offered as a free PDF download from OUP and selected open access locations. BL Distinguished editors and contributors BL Addresses questions of some urgency for the question of women's quality of life BL Inter-disciplinary, ranging over philosophy, economics, political science, anthropology, law and sociology BL Combines theory with case-studies BL Accessible to non-specialist reader BL Sequel to The Quality of Life, edited by Martha Nussbaum and Amartya Sen, applying the 'capabilities' approach outlined in that volume BL Topical - challenges 'politically correct' relativist approaches and discusses the validity of charges of 'cultural imperialism' levelled at Western aid and intervention policies. Women, a majority of the world's population, receive only a small proportion of its opportunities and benefits. According to the 1993 UN Human Development Report, there is no country in the world in which women's quality of life is equal to that of men. This examination of women's quality of life thus addresses questions which have a particular urgency. It aims to describe the basic situation of all women and so develops a universal account that can answer the charges of 'Western imperialism' frequently made against such accounts. The contributors confront the issue of cultural relativism, criticizing the relativist approach which, in its desire to respect different cultural traditions, can result in indifference to injustice. An account of gender justice and women's equality is then proposed in various areas in which quality of life is measured. These issues are related throughout to the specific contexts of India, Bangladesh, China, Mexico, and Nigeria through a series of case studies. Disciplines represented include philosophy, economics, political science, anthropology, law, and sociology. Like its predecessor, The Quality of Life, this volume encourages the reader to think critically about the central fundamental concepts used in development economics and suggests major criticisms of current economic approaches from that fundamental viewpoint. Contributors: Martha Nussbaum, Marty Chen, Susan Wolf, Jonathan Glover, Onora O'Neill, David Crocker, Hilary Putnam, Linda Alcoff, Amartya Sen, Susan Moller Okin, Ruth Anna Putnam, Cass R.Sunstein, Christine M.Korsgaard, Catherine Lutz, Xiaorong Li, Margarita M.Valdes, Nkiru Nzegwu

Book excerpt: There are quite a litany of factors militating against the growth and liberty of the girl children in Nigeria, and unless we want to wallow in open-deceit and perpetual self-denial, I believe it is time we stood up with a collective resolve to pull down all the identify able barriers we can see around us as veritable start off point towards ensuring that Nigeria stands tall in the league of nations that are battling to eliminate all forms of gender bias and gender discrimination. Today's Nigeria must begin to condemn all forms of inhuman treatment against the girl child as intolerable and nationally unacceptable. The challenges facing the child today range from social, economic, emotional, psychological, cultural and religious. There is no gain-saying that the girl child in Nigeria is high disadvantaged in our society and one cannot over-stress the fact that the challenges she face in the quest for being relevant is fraught with several hurdles which in themselves had been mantled over time to inhibit her growth and progress. The very road she has been made to thread on as she transits from girl hood to womanhood is one that she has had to fight for, hard and rough, to assert her existence as part of humanity. If we consider the fact that many fathers still think that it is best to have a male child instead of a girls, simply because they want someone who will carry on the name of the family when they are gone in this age and time regardless of whether the boy would turn out to be a misfit and a big failure then we cannot but agree that some of these misplaced notions that we hang on to will not take us anywhere. If preparing to send the male child to school even when he is clearly a dullard, and choosing to send the girl child to hawk on the street to raise money for her brother's education is not discriminatory, then one wonders what to call it. The sacrifices the girl is forced to make as a cleansing ritual to pave the way for a family's wellbeing is not only crude but wicked. There are several harmful cultural and traditional practices that still take place in many communities in Nigeria today and even across several other African countries that still pose as a big hindrance to the realization of her full potentials. A good number of women who suffer from very low-self-esteem live so because of the very oppressive and humiliating experiences they were put through from childhood. Something that one finds as an irony of sort is that a great number of adults who engage in promoting some of these harmful challenges cannot be said to be ignorant of the futility of their actions but because of age-old cultural beliefs and traditional hangovers, they have simply refused to accept the fact that the girl child has equal rights to life and to living as well. It is very easy to deny the hypocrisy of our society when it comes to gender dichotomy but the very hard truth which we all know incidentally, is that these discriminatory tendencies occur every day, around us. The travails of the girl child is part of the reasons why there are so many inconsistence's in various sphere of life in Nigeria today. This is because she has had to go the extra mile and sometimes undertake to do the extraordinary before she is appreciated and respected. To those of them that are not very strong-willed the sheer weight of inferiority complex that she lives has turned out to be a very heavy burden and elixir that has continued to discourage her from moving beyond where she finds herself. From the homes, schools, church, workplace, mosque, market and social gatherings. The girl child is mostly singled out for Christians that sometimes thrive from the mundane to the very absurd
