Using the dialectical tensions inherent to competing moral claims as his starting point, Michael Steinmann explains what he terms the “failure of morality” both in classical and contemporary positions. As moral claims lead in various ways to contradictions, the history of morality presents itself as an endless series of controversies. By using dialectical thinking, which has gone out of favour in current philosophy, Steinmann shows how we can capture the limitations of moral theories in a more holistic way. Without embracing skepticism about moral claims, a non-naturalistic and non-relativistic understanding of the good emerges as the fundamental notion of moral thought. Reframing Ethics Through Dialectics reinvigorates the classical notion of “the absolute good” as a fruitful conceptual structure through which to understand competing moral claims, without simply reproducing neo-Aristotelian literature on the good life. From the perspective of the good, the study allows us to take non-traditional theories more seriously, making space for moral philosophy to acknowledge and embrace the contradictions that all positions incur.

Book excerpt: This book offers a defence of Wrightean epistemic entitlement, one of the most prominent approaches to hinge epistemology. It also systematically explores the connections between virtue epistemology and hinge epistemology. According to hinge epistemology, any human belief set is built within and upon a framework of pre-evidential propositions – hinges – that cannot be justified. Epistemic entitlement argues that we are entitled to trust our hinges. But there remains a problem. Entitlement is inherently unconstrained and arbitrary: We can be entitled to any hinge proposition under the right circumstances. In this book, the author argues that we need a non-arbitrariness clause that protects entitlement from defeat. This clause, he argues, is to require epistemic virtue. Virtuous cognitive dispositions provide the non-arbitrariness clause that protects entitlement from defeat. The epistemic character of the agent who holds a particular set of hinges tells us something about the hinges’ epistemic status. Conversely, epistemic virtues are cognitive dispositions and capacities that rely on hinge propositions – without trusting in some hinges, we would be unable to exercise our virtues. Although all scholars recognize the influence of Merleau-Ponty, so far no one has demonstrated the fundamental coherence between Merleau-Ponty’s theory and the main concepts proposed by Lefort; in particular between the concept of institution and the definitions of social and democracy. If Merleau-Ponty uses the idea of institution to think beyond the division between subject and object, to think together continuity and difference, permanence and change, this same concept allows Lefort to understand society as both conflict and unity. From this starting point, this study will attempt to clarify Lefort’s concept of the political and his interpretations of modernity, humanism, and the work of Niccolò Machiavelli. These very concepts will show the difference from structuralism, Michel Foucault’s contemporary theory and theories of immanence. At the same time this study highlights an internal tension in Lefort’s own thinking: between autonomy and experience, institution and insurgence.

It discusses whether to support explanatory pluralism or explanatory unification and focuses on possible compromises between ecological psychology and enactivism. The second category addresses ontological questions regarding the synchronic and diachronic constitution of cognitive phenomena, the localization of cognitive processes, and the theoretical issue of mutual manipulability. The third category analyzes how the theoretical and practical commitments of 4E approaches lead to empirically supported investigations of different phenomena, such as research on affordances and (chronic) pain. The book renews attention to the possible adverse consequences coming along with methodical fragmentation, as found among 4E positions. It provides an overdue first step towards a systematic and positive answer to methodological concerns in situated cognition research. Without this and further steps in the future, the growth of 4E ́s significance for the scientific study of the mind might stall or even decrease. With such steps, situated cognition research could realize its frequently highlighted but so far not comprehensively accessed potential to change radically the modalities of how cognitive phenomena are studied. From the medicalization of politics to the disciplining of individuals, from lockdowns to mass vaccination programs, contemporary societies seem to be firmly embedded in a syndrome of immunity. To understand the ambivalent effects of this development, it is necessary to go back to its modern genesis, when the languages of law, politics, and medicine began to merge into the biopolitical regime we have been living under for some time. This regime places a high priority on immunization and security: no security is more important than health security. The Covid-19 pandemic has taken the dynamic of immunization to a new level: for the first time in history, we see societies seeking to achieve generalized immunity in their entire populations through vaccination. This allows us to glimpse the possibility of a “common immunity” that strengthens the relation between community and immunity. The dramatic tensions we have experienced in recent years between security and freedom, norm and exception, power and existence, all refer to the complex relationship between community and immunity, the decisive features of which are reconstructed in this book. Building on the prescient argument originally developed two decades ago in Immunitas, Roberto Esposito demonstrates in this new book how the pandemic and our responses to it have brought into sharp relief the fundamental biopolitical conditions of our contemporary societies.

Book excerpt: A theme of growing importance in both the law and philosophy and socio-legal literature is how regulatory dynamics can be identified (that is, conceptualised and operationalised) and normative expectations met in an age when transnational actors operate on a global plane and in increasingly fragmented and transformative contexts. A reconsideration of established theories and axiomatic findings on regulatory phenomena is an essential part of this discourse. There is indeed an urgent need for discontinuity regarding what we (think we) know about, among other things, law, legality, sovereignty and political legitimacy, power relations, institutional design and development, and pluralist dynamics of ordering under processes of globalisation and transnationalism. Making an important contribution to the scholarly debate on the subject, this volume features original and much-needed essays of theoretical and applied legal philosophy as well as socio-legal accounts that reflect on whether legal positivism has anything to offer to this intellectual enterprise. This is done by discussing whether global and transnational cultural, socio-political, economic, and juridical challenges as well as processes of diversification, fragmentation, and transformation (significantly, de-formalisation) reinforce or weaken legal positivists’ assumptions, claims, and methods.
