A educação ambiental é fundamental para que o Direito Ambiental possa alcançar seu objetivo de estabelecer normas que consigam auferir efetivamente o objetivo de preservação do meio-ambiente como um todo. É diante da necessidade de aprofundamento da reflexão sobre os desafios para mudar as formas de pensar e agir em torno da questão ambiental numa perspectiva contemporânea que vem o presente livro. Direito Ambiental é Direito, e exige soluções jurídicas para questões jurídicas. Educação Ambiental é Educação e exige metodologias educacionais para problemas educacionais.

The Paris Agreement has a binding commitment of holding the global temperature increase to 2°C while pursuing efforts to limit it to 1.5°C. To cope with the negative effects of climate changes and mitigate greenhouse gas emissions, one of the primary responses has been the deployment of renewable energy sources, transiting from fossil fuels to sustainable electricity production. However, renewable energy sources can also cause significant environmental impacts. Wind energy, for instance, can impact biodiversity, such as birds and bats, killing them when colliding with turbines and affecting their migration and nesting. This results in conflicts in environmental law. This book questions whether, in the energy transition, the generation of electricity from renewable sources to protect the climate is compatible with the protection of the environment, both interests in environmental law. To address this question, this book follows a legal-environmental perspective and assesses the common problem of solving those internal environmental conflicts in Brazilian and German law to understand and compare whether and how both legal systems solve the conflicts by compatibilizing the protection of the climate with other environmental interests. The legal analysis focuses on land-use planning and environmental licensing, assessing similarities and differences, and evaluating the results, identifying what one country can learn from the other.

Book excerpt: The Convention on Biological Diversity (CBD) strives for the sustainable and equitable utilization of genetic resources, with the ultimate goal of conserving biodiversity. The CBD and the Nagoya Protocol which has since been elaborated suggest a bilateral model for access to genetic resources and the sharing of benefits from their utilization. There is concern that the bilateral exchange "genetic resource for benefit sharing" could have disappointing results because providers are left out of the process of research and development, benefits are difficult to be traced to sources, and providers owning the same resource may complain of being excluded from benefit sharing. Thus, the CBD objective of full utilization and equitability may become flawed. Common Pools of Genetic Resources: Equity and Innovation in International Biodiversity Law suggests common pools as a complementary approach to bilateralism. This is one of the first books to reply to a number of complex legal questions related to the interpretation and implementation of the Nagoya Protocol. Taking an inductive approach, it describes existing pools and analyzes how they are organized and how they perform in terms of joint R&D and benefit sharing. It presents case studies of the most characteristic types of common pools, provides suggestions for further developing existing pools to cope with the requirements of the CBD and NP and, at the same time uses the clauses these conventions contain to open up for commons approaches. How did they maintain their political autonomy and territorial sovereignty, hundreds of years after the arrival of Europeans? In a study that spans the eighteenth to twentieth centuries and ranges across the vast interior of South America, Heather F. Roller examines this history of power and persistence from the vantage point of autonomous Native peoples in Brazil. The central argument of the book is that Indigenous groups took the initiative in their contacts with Brazilian society. Rather than fleeing or evading contact, Native peoples actively sought to appropriate what was useful and potent from outsiders, incorporating new knowledge, products, and even people, on their own terms and for their own purposes. At the same time, autonomous Native groups aimed to control contact with dangerous outsiders, so as to protect their communities from threats that came in the form of sicknesses, vices, forced labor, and land invasions. Their tactical decisions shaped and limited colonizing enterprises in Brazil, while revealing Native peoples' capacity for cultural persistence through transformation. These contact strategies are preserved in the collective memories of Indigenous groups today, informing struggles for survival and self-determination in the present.
