Deste modo, o livro regressaria a público desactualizado, em desacordo com o que tem sucedido. Optei, assim, por reformulações, onde se incluíram, conservando o mais possível a paginação, as mudanças sucessivas que pareceram de maior relevo na perspectiva do direito das obrigações. As fichas técnicas marcam, respectivamente, os limites temporais de 31 de Março de 2008 e de 15 de Outubro de 2009. Eis o quadro em que surge agora a 12.a edição, também ultimada rapidamente e sobreposta a outros projectos. Ainda encontrei ânimo e perseverança para uma revisão empenhada que acompanhasse as constantes e amiúde surpreendentes reformas legislativas, incluindo crescentes e não raro mal-amadas transposições comunitárias, a linha da construção dogmática, os rumos jurisprudenciais e a produção bibliográfica. Como regra, remete-se para a última versão conhecida. Todas as apreensões confessadas em Nota Prévia à 10.a Edição se confirmaram e até avolumaram. Não superei por completo as dúvidas e incertezas que me surgiram como frágil nauta de tão revolto oceano jurídico-cientifico e prático. Simplesmente, pretendi, de novo, cumprir o que estava ao meu alcance, embora nunca esquecendo que os livros jurídicos, enquanto assentes no direito positivo, lembram, cada vez mais, os escritos em areia ao vento.
