Book excerpt: This report considers that the digital euro can be introduced under the ECB's primary mandate as legal tender and be remunerated. However, in order to lawfully create the proposed digital euro app, the ECB would require a mandate from the EU legislator under its secondary mandate which has to comply with article 119 TFEU, fundamental rights and data protection regulation. The supervision should be through the European Data Protection Supervisor. Finally, the digital euro should not exclude those lacking digital skills and minimum standards should be introduced regarding the availability of cash. This document was provided by the Economic Governance and EMU Scrutiny Unit at the request of the ECON Committee.

This lays the groundwork for a further analysis of the main legal aspects of the new European Directive, its improvements, its tendencies and its points of controversy, with special and more concrete attention to how it proposes to address the issues of competition, transparency and multi-territorial licensing. Digital technologies, networks and communication have boosted the production and distribution of intellectual content. These activities are based on a renewable and infinite resource – creativity – which turns this content into strategic artistic, cultural, social, economic and informational assets. Managing the rights and obligations that emerge in this system has never been an easy task; managing them collectively, which is more often than not the case, adds even more complexity. The European Directive on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market is a policy initiative that seeks to establish an adequate legal framework for the collective management of authors’ rights in a digital environment, recognizing this goal as crucial to achieving a fully integrated Single Market. Part of the Digital Agenda for Europe, it is an effort to promote simplification and to enhance the efficiency of collective rights management by tackling three of the main issues that are currently undermining the business model of collecting societies: competition, transparency and multi-territorial licensing. The book is intended to support students, academics and practitioners by enhancing their general and legal grasp of these phenomena, while also encouraging their collaboration with policymakers and other interested parties in the ongoing task of transposing the Directive into concrete national legislation.

Book excerpt: This paper analyzes the legal foundations of central bank digital currency (CBDC) under central bank and monetary law. Absent strong legal foundations, the issuance of CBDC poses legal, financial and reputational risks for central banks. While the appropriate design of the legal framework will up to a degree depend on the design features of the CBDC, some general conclusions can be made. First, most central bank laws do not currently authorize the issuance of CBDC to the general public. Second, from a monetary law perspective, it is not evident that “currency” status can be attributed to CBDC. While the central bank law issue can be solved through rather straithforward law reform, the monetary law issue poses fundmental legal policy challenges.

Book excerpt: Is the EU constitutional framework proof for the issuance of euro banknotes, coins, and digital euros alike? This Chapter focuses on the legal mandate of the ECB at primary level, namely following the EU Treaties, for issuing a Central Bank Digital Currency (CBDC) that has been named 'digital euro' in the EU context. The currency is a vehicle for public money, whose format can change to deliver appropriately the tasks and functions of the central bank. Therefore, I argue that the right to issue euro banknotes can encompass the right to determine the format or medium of 'euro banknotes', which is, in that case transposing to the digital reality of the economy. The ECB Governing Council stressed the objective to ensure an openly accessible, electronic means of payment, for retail, which I coin as 'universal and inclusive'. This means not only to ensure the wide availability and use of the digital euro, but also to consider the complementary phases within the digital euro 'scheme', namely, its issuance, distribution, and settlement. I concur with the approach of the cumulation of legal bases which enables, legally and constitutionally, the entire digital euro scheme - now put forward by the European Commission under the 'Single Currency Package'.The Chapter is structured as follows: Section 2 lays down the EU constitutional and primary law analysis, by focusing on the Treaty mandate of the ECB for issuing a CBDC. Section 3 discusses the importance of legal tender for both the euro coins/banknotes and the future CBDC - despite the limits of this concept across the euro area Member States. Section 4 engages with some broader constitutional challenges in issuing CBDCs and discusses some other legal issues that can significantly influence the digital euro scheme, including at its operational level. Section 5 concludes the Chapter.
