Yet the crisis, economic and political, that faces this small Caribbean nation did not begin with the dictatorship, and is far from being solved, despite its departure from the scene. In this fascinating study, Haitian-born Michel-Rolph Trouillot examines the mechanisms through which the Duvaliers ruthlessly won and then held onto power for twenty-nine years. Trouillot's theoretical discussion focuses on the contradictory nature of the peripheral state, analyzing its relative autonomy as a manifestation of the growing disjuncture between state and nation. He discusses in detail two key characteristics of such regimes: the need for a rhetoric of national unity coupled with unbridled violence. At the same time, he traces the current crisis from its roots in the nineteenth-century marginalization of the peasantry through the U.S. occupation from 1915 to 1934 and into the present. He ends with a discussion of the post-Duvalier period, which, far from seeing the restoration of civilian-led democracy, has been a period of increasing violence and economic decline.

The government of Haiti responded by re-opening a 2008 investigation into alleged financial crimes, and several victims of serious human rights violations under the Duvalier regime also came forward and filed complaints with the prosecutor. The investigation into Duvalier's alleged financial and human rights crimes is currently underway. Haiti's Rendez-Vous with History provides an overview of human rights violations under Duvalier, details the current status of the proceedings against him, including obstacles to a successful prosecution, and analyzes applicable Haitian and international law. We conclude that investigation and prosecution of the grave violations of human rights under Duvalier's rule is required by Haiti's obligations under international law. While there are still obstacles to overcome, the case presents an historic opportunity for Haiti. Successful prosecution of Duvalier is important not only for Duvalier's many victims, but also for Haiti's struggling judicial system and for Haitian society more broadly. Bringing Duvalier to justice and giving him a fair trial could help restore Haitians' faith in the justice system and the rule of law. A prosecution could also act as a deterrent to other leaders, both in Haiti and elsewhere, demonstrating that they can be held accountable for serious violations of human rights. The challenges to fair and transparent prosecution of Duvalier are enormous but not insurmountable. The success of the case will depend on the political will of the government of Haiti to uphold its obligations under international law and rigorously pursue what could be the most important criminal case in its history, and on the willingness of the international community to provide essential support now and as the case develops."--P. In that year, too, another sort of Haitian independence occurred, as the United States ended nearly two decades of occupation. In the first comprehensive political history of postoccupation Haiti, Matthew Smith argues that the period from 1934 until the rise of dictator Francois "Papa Doc" Duvalier to the presidency in 1957 constituted modern Haiti's greatest moment of political promise. Smith emphasizes the key role that radical groups, particularly Marxists and black nationalists, played in shaping contemporary Haitian history. These movements transformed Haiti's political culture, widened political discourse, and presented several ideological alternatives for the nation's future. They were doomed, however, by a combination of intense internal rivalries, pressures from both state authorities and the traditional elite class, and the harsh climate of U.S. anticommunism. Ultimately, the political activism of the era failed to set Haiti firmly on the path to a strong independent future.
