Book excerpt: The English System is a history of port health and immigration at a critical moment of transformation at the end of the nineteenth and beginning of the twentieth century. During the later nineteenth century, British public health officials transformed the medieval quarantine system into a novel ‘English System’ of surveillance to control the introduction of infectious disease. This removed the much maligned hindrances of quarantine to high-speed international commerce and for maritime traffic through Britain’s ports. At the same time, calls were made to restrict the arrival of increasing numbers of European immigrants and transmigrants. This book explores the tensions and transition in the regulation of port health from a paradigm focused on the origin of disease to one which converged on the origin of the diseased.

Evangelical leaders, public health officials, and the Reagan administration quickly capitalized on widespread fear of the new disease to call for quarantines, immigration bans, and deportations, scapegoating and blaming HIV-positive migrants—even as the rest of the world regarded the US as the primary exporter of the virus. In The Borders of AIDS, Karma Chávez demonstrates how such calls proliferated and how failure to impose a quarantine for HIV-positive citizens morphed into the successful enactment of a complete ban on the regularization of HIV-positive migrants—which lasted more than twenty years. News reports, congressional records, and AIDS activist archives reveal how queer groups and migrant communities built fragile coalitions to fight against the alienation of themselves and others, asserting their capacity for resistance and resiliency. Building on existing histories of HIV/AIDS, public health, citizenship, and immigration, Chávez establishes how politicians and public health officials treated different communities with HIV/AIDS and highlights the work these communities did to resist alienation.

Historically the term "war crime" struck some as redundant and others as oxymoronic: redundant because war itself is criminal; oxymoronic because war submits to no law. More recently, the remarkable trend toward the juridification of warfare has emerged, as law has sought to stretch its dominion over every aspect of the waging of armed struggle. No longer simply a tool for judging battlefield conduct, law now seeks to subdue warfare and to enlist it into the service of legal goals. Law has emerged as a force that stands over and above war, endowed with the power to authorize and restrain, to declare and limit, to justify and condemn.
