Deterrence, whether through preventive patrol by police officers or stiff prison sentences for violent offenders, is the principal mechanism through which the central feature of criminal justice, the exercise of state authority, works – it is hoped -- to diminish offending and enhance public safety. And however well we think deterrence works, it clearly often does not work nearly as well as we would like – and often at very great cost. Drawing on a wide range of scholarly literatures and real-world experience, Kennedy argues that we should reframe the ways in which we think about and produce deterrence. He argues that many of the ways in which we seek to deter crime in fact facilitate offending; that simple steps such as providing clear information to offenders could transform deterrence; that communities may be far more effective than legal authorities in deterring crime; that apparently minor sanctions can deter more effectively than draconian ones; that groups, rather than individual offenders, should often be the focus of deterrence; that existing legal tools can be used in unusual but greatly more effective ways; that even serious offenders can be reached through deliberate moral engagement; and that authorities, communities, and offenders – no matter how divided – share and can occupy hidden common ground. The result is a sophisticated but ultimately common-sense and profoundly hopeful case that we can and should use new deterrence strategies to address some of our most important crime problems. Drawing on and expanding on the lessons of groundbreaking real-world work like Boston’s Operation Ceasefire – credited with the "Boston Miracle" of the 1990s – "Deterrence and Crime Prevention" is required reading for scholars, law enforcement practitioners, and all with an interest in public safety and the health of communities.

Researchers have reached widely varying, even contradictory, conclusions. Some studies have concluded that the threat of capital punishment deters murders, saving large numbers of lives; other studies have concluded that executions actually increase homicides; still others, that executions have no effect on murder rates. Commentary among researchers, advocates, and policymakers on the scientific validity of the findings has sometimes been acrimonious. Against this backdrop, the National Research Council report Deterrence and the Death Penalty assesses whether the available evidence provides a scientific basis for answering questions of if and how the death penalty affects homicide rates. This new report from the Committee on Law and Justice concludes that research to date on the effect of capital punishment on homicide rates is not useful in determining whether the death penalty increases, decreases, or has no effect on these rates. The key question is whether capital punishment is less or more effective as a deterrent than alternative punishments, such as a life sentence without the possibility of parole. Yet none of the research that has been done accounted for the possible effect of noncapital punishments on homicide rates. The report recommends new avenues of research that may provide broader insight into any deterrent effects from both capital and noncapital punishments.

Book excerpt: Whole World on Fire focuses on a technical riddle wrapped in an organizational mystery: How and why, for more than half a century, did the U.S. government fail to predict nuclear fire damage as it drew up plans to fight strategic nuclear war?U.S. bombing in World War II caused massive fire damage to Hiroshima and Nagasaki, but later war plans took account only of damage from blast; they completely ignored damage from atomic firestorms. Recently a small group of researchers has shown that for modern nuclear weapons the destructiveness and lethality of nuclear mass fire often--and predictably--greatly exceeds that of nuclear blast. This has major implications for defense policy: the U.S. government has underestimated the damage caused by nuclear weapons, Lynn Eden finds, and built far more warheads, and far more destructive warheads, than it needed for the Pentagon's war-planning purposes. How could this have happened? The answer lies in how organizations frame the problems they try to solve. In a narrative grounded in organization theory, science and technology studies, and primary historical sources (including declassified documents and interviews), Eden explains how the U.S. Air Force's doctrine of precision bombing led to the development of very good predictions of nuclear blast--a significant achievement--but for many years to no development of organizational knowledge about nuclear fire. Expert communities outside the military reinforced this disparity in organizational capability to predict blast damage but not fire damage. Yet some innovation occurred, and predictions of fire damage were nearly incorporated into nuclear war planning in the early 1990s. The author explains how such a dramatic change almost happened, and why it did not. Whole World on Fire shows how well-funded and highly professional organizations, by focusing on what they do well and systematically excluding what they don't do well, may build a poor representation of the world--a self-reinforcing fallacy that can have serious consequences. In a sweeping conclusion, Eden shows the implications of the analysis for understanding such things as the sinking of the Titanic, the collapse of the Tacoma Narrows Bridge, and the poor fireproofing in the World Trade Center.
