Book excerpt: Este libro reflexiona en torno a las implicaciones de la actual configuración constitucional de los derechos y sus garantías, derivadas de la reforma de 2011, partiendo de una concepción amplia de los derechos humanos que incluye a los económicos, sociales y culturales y a toda una serie de derechos que se han venido reconociendo desde las últimas décadas del siglo xx hasta nuestros días, como los derechos de la mujer y los derechos colectivos de los pueblos indígenas. Los trabajos aquí reunidos se ocupan principalmente de un cierto tipo de implicaciones, las de tipo teórico-conceptual, de orden metodológico o interpretativo y las de tipo histórico, ya que estas son determinantes para la eficacia de esta reforma, que nos obliga a repensar y reconceptualizar nuestra idea de los derechos constitucionales y su protección. El autor sostiene que las implicaciones de la reforma en materia de derechos humanos tienen que ir más lejos, lo que implica hacer una revisión doctrinal profunda. Entre estas, se encuentran las de orden conceptual, que nos obligan a analizar los conceptos de “derechos humanos”, “derechos constitucionales”, “interés legítimo”, entre otros, y atender a los cambios producidos al haberse abandonado otros conceptos. La tesis que se defiende sostiene que la centralidad que tiene el concepto de “derechos humanos” nos debe llevar a un cambio en nuestra doctrina constitucional; los constitucionalistas tienen ahora la obligación de adecuar sus teorías dogmáticas a este cambio conceptual. El análisis aquí presentado no solo es el de un constitucionalista, sino el de un filósofo o teórico del derecho que trata de advertir sobre algunos de los retos que ahora tienen enfrente los constitucionalistas. Se intenta orientar cómo entender estos desafíos y ensayar, a partir de la experiencia del autor, en temas de derechos humanos que permitan visualizar algunos temas, problemas y sus soluciones.

Los autores, en su mayoría miembros de los dos Institutos de derechos humanos de universidades públicas que existen en nuestro país (el Instituto Bartolomé de las Casas de la Universidad Carlos III y el Instituto de derechos humanos de la Universitat de València), no han querido seguir el habitual (y, sin duda, útil) camino de la glosa, enriquecida con las referencias a debates y derecho y jurisprudencia comparadas, propio de los manuales al uso. Todos los que aquí escriben coinciden por así decirlo (dentro de un abanico de considerable pluralidad ideológica) en una tesis de partida: la convicción de que jamás en la historia de nuestro país hemos contado con un período semejante de reconocimiento de derechos humanos y constitucionales. Pero son conscientes también de que eso no significa, ni de lejos, confundir ese juicio con la creencia de que habitamos en la mejor de las Constituciones posibles, desde el punto de vista del reconocimiento y garantía de los derechos. Es decir, son, somos conscientes de que el motor que explicara Jhering, la "lucha por el Derecho", entendido en clave de "lucha por los derechos" exige entender esa paideia propia de los profesores de nuestros Institutos como una tarea de permanente revisión. Y por eso proponen, proponemos, una lectura de esos derechos sobre todo en clave de futuro, como programa a desarrollar, como propuesta inacabada, en permanente adaptación al contexto, a las necesidades concretas y reales, que cambian e incluso surgen de forma no prevista, y exigen hablar también de derechos que no están suficientemente considerados en el texto constitucional y aun de nuevos derechos.

Based on original data and a region-specific methodology, the book provides a systematic analysis utilising more than 600 leading cases. It shows which interpretive methods and concepts are most favoured by Latin American courts, and which courts were the most prolific in their reasoning activities. The volume traces the features of judicial dialogue on a regional and sub-regional level and enables the evaluation and comparison of each country's reasoning culture in different epochs. The collection includes several graphs to visualise the changes and tendencies of the reasoning practices throughout time in the region, based on information gathered from the dataset. To better understand the current functioning and the future tendencies of courts in Latin America and the Caribbean, the volume illuminates how constitutional and supreme courts have actually been making their decisions in the selected landmark cases, which could also contribute to future successful litigation strategies for both national constitutional courts and the Inter-American Court for Human Rights. Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law.
