Book excerpt: La Comunidad Andina de Naciones (CAN) es una integración entre cuatro países latinoamericanos buscando un desarrollo integral especialmente en términos económicos. Como parte de dicha integración, los países miembros determinaron que en materia de propiedad intelectual la legislación sería conjunta. De esta forma, la CAN promulgó el régimen común de derechos de autor y derechos conexos el cual es de aplicación y efecto directo al interior de los países miembros. No obstante, los países miembros de la Comunidad han entrado en diversas negociaciones de Tratados de Libre Comercio (TLC), los cuales requieren al país contratante la implementación de ciertas disposiciones en materia de derechos de autor y derechos conexos, como en el caso de los TLC firmados con Estados Unidos. El problema comienza cuando las disposiciones mandadas a implementar a través de los TLC difieren de aquellas establecidas por la can, requiriendo al país miembro de la Comunidad establecer estándares de protección más altos que los establecidos por la CAN o a regular aspectos sobre los cuales la Comunidad no se ha pronunciado. Este artículo analiza si el bilateralismo llevado a cabo por Estados Unidos en los últimos años en el ámbito de derechos de autor y derechos conexos está generando o generará conflictos de leyes al interior del régimen común de derechos de autor y derechos conexos de la CAN. The Andean Community is a custom union between four Latin American countries seeking for comprehensive development especially in economics. As part of this integration, the countries establish that the regulation of intellectual property law will be enacted jointly. Therefore, the Andean Commission enacts the law regarding copyright and neighboring rights. This law is implemented and executed directly in the Andean Community members without the need of an implementation procedure under the national law of the member countries. However, the Andean countries have been negotiating several free trade agreements. These FTAS require the trading party to implement some provisions in the field of copyright law, as in the case of the FTAS negotiated with the United States. The problem arises when the provisions required by the FTA differ from the provisions already set by the Andean Commission, requiring the Andean countries to set stronger levels of copyright protection or to regulate aspects than the Andean community has not regulated. Therefore, this paper will analyze whether the U.S bilateralism is generating or will generate a conflict of laws within the Andean Community copyright regime. If this is the case, solving this conflict of laws may infringe the international obligations that may lead to international responsibility to some member countries.

In the past 15 years, the nations of the Western Hemisphere have staged a remarkable revolution—in the way they trade with their neighbors. First, after decades of restrictive import policies, several countries began to liberalize their trade and investment regimes. Then, beginning a decade ago, numerous bilateral and sub-regional trade agreements were achieved, to serve as vital complements to domestic reforms and to foster trade flows among member countries. At the Second Summit of the Americas in 1998, negotiations among 34 democracies were launched to establish the Free Trade Area of the Americas (FTAA). This report takes stock of the remarkable progress to date in the development of free trade in the Western Hemisphere. It examines trade flows between countries in the same regional groupings and between members of different sub-regional arrangements. The report describes the main characteristics of the trade arrangements signed between countries of the Hemisphere and explores the development of trade rules in these arrangements. Finally, the report details recent advances in the construction of the FTAA.
