Section V reviews intermediary liability enforcement strategies by focusing on emerging trends, including proactive monitoring obligations across the entire spectrum of intermediary liability subject matters, blocking orders against innocent third parties, and the emergence of administrative enforcement of intermediary liability online. In addition, Section VI discusses an additional core emerging trend in intermediary liability enforcement: voluntary measures and private ordering. Finally, international private law issues are addressed in Section VII with special emphasis on the international struggle over Internet jurisdiction and extra-territorial enforcement of intermediaries' obligations.

By the late 1990s, digital activists embraced a philosophy of free software and "free culture" in order to take control over their cities and everyday lives. Free culture, previously tethered to the digital realm, was cut loose and used to reclaim and resculpt the city. In Madrid the effects were dramatic. Common sights in the city were abandoned as industrial factories turned into autonomous social centers, urban orchards, guerrilla architectural camps, or community hacklabs. Drawing on two decades of ethnographic and historical work with free culture collectives in Madrid, Free Culture and the City shows how, in its journey from the digital to the urban, the practice of liberating culture required the mobilization of, and alliances between, public art centers, neighborhood associations, squatted social centers, hackers, intellectual property lawyers, street artists, guerrilla architectural collectives, and Occupy assemblies.

El sentido actual de lo común se distingue de los numerosos usos que se ha dado a esta noción, ya sean filosóficos, jurídicos o teológicos: bien supremo de la ciudad, universalidad de esencia, propiedad inherente a ciertas cosas, incluso alguna vez el fin perseguido por la creación divina. Pero hay otro hilo que vincula lo común, no a la esencia de los hombres o a la naturaleza de las cosas, sino a la actividad de los hombres mismos: sólo una práctica de puesta en conjunto puede decidir qué es “común”, reservar ciertas cosas al uso común, producir determinadas reglas capaces de obligar a los hombres. En este sentido, lo común reclama una nueva institución de la sociedad por ella misma: una revolución.
