Book Derecho y factor religioso

Download or read book Derecho y factor religioso written by José María Porras Ramírez and published by . This book was released on 2011-09-05 with total page 264 pages. Available in PDF, EPUB and Kindle.

Book Latin American Perspectives on Law and Religion

Download or read book Latin American Perspectives on Law and Religion written by Rodrigo Vitorino Souza Alves and published by Springer Nature. This book was released on 2020-05-16 with total page 169 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book makes a valuable contribution to the fascinating global debate on the meaning and scope of freedom of religion or belief and the relations between state, society and religion. It offers a cross-thematic approach to law and religion from the Global South. Law and religion have been consolidated to form a specific area of study in recent years. However, due to language barriers, most of the regional and national debates within Latin America have not been accessible to interested audiences from other parts of the world. Despite the specificities of the Latin American context, the issues, arrangements and processes that have been negotiated and developed in this part of the Global South make a valuable contribution to addressing the challenges that have arisen in other regions. The book analyses the intersections and interactions between religion and other far-reaching subjects such as politics and democracy, traditional cultures, national and ethnic groups, majorities and minorities, public education, management of diversity, intolerance and violence, as well as secularism and equality. The collection of essays is of interest not only to legal scholars and practitioners, but also to sociologists, political scientists and theologians, as well as to policymakers and civil society organizations.

Available in PDF, EPUB and Kindle. Book excerpt: What is the place assigned to religion in the constitutions of contemporary States? What role is religion expected to perform in the fields that are the object of constitutional regulation? Is separation of religion and politics a necessary precondition for democracy and the rule of law? These questions are addressed in this book through an analysis of the constitutional texts that are in force in different parts of the world. Constitutions are at the centre of almost all contemporary legal systems and provide the principles and values that inspire the action of the national law-makers. After a discussion of some topics that are central to the constitutional regulation of religion, the book considers a number of national systems covering countries with a variety of religious and cultural backgrounds. The final section of the book is devoted to the discussion of the constitutional regulation of some particularly controversial issues, such as religious education, the relation between freedom of speech and freedom of religion, abortion, and freedom of conscience.

Book Religion Rights and Secular Society

Download or read book Religion Rights and Secular Society written by Peter Cumper and published by Edward Elgar Publishing. This book was released on 2012-01-01 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: ÔReligion, Rights and Secular Society by Peter Cumper and Tom Lewis is a both timely and important publication. In a series of highly interesting and well-written essays Ð some of which are case studies covering many different European nations whereas others are more theoretical Ð the book looks at a key paradox in contemporary Europe: the relatively high levels of secularity in most European countries on the one hand, and the marked resurgence of religion in public debates on the other. While never pretending that there are ready answers to the problems of reconciling secular and religious values in Europe, the contributors make it quite clear that Europeans need to return to questions about religion that they had previously regarded as being settled. This is food for thought at a very high level!Õ Ð Helle Porsdam, University of Copenhagen, Denmark This topical collection of chapters examines secular society and the legal protection of religion and belief across Europe, both in general and more nation-specific terms. The expectations of many that religion in modern Europe would be swept away by the powerful current of secularization have not been realised, and today few topics generate more controversy than the complex relationship between religious and secular values. The Ôreligious/secularÕ relationship is examined in this book, which brings together scholars from different parts of Europe and beyond to provide insights into the methods by which religion and equivalent beliefs have been, and continue to be, protected in the legal systems and constitutions of European nations. The contributorsÕ chapters reveal that the oft-tumultuous legacy of EuropeÕs relationship with religion still resonates across a continent where legal, political and social contours have been powerfully shaped by faith and religious difference. Covering recent controversies such as the Islamic headscarf, and the presence of the crucifix in school class-rooms, this book will appeal to academics and students in law, human rights and the social sciences, as well as law and policy makers and NGOs in the field of human rights.

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this convenient resource provides systematic information on how Spain deals with the role religion plays or can play in society, the legal status of religious communities and institutions, and the legal interaction among religion, culture, education, and media. After a general introduction describing the social and historical background, the book goes on to explain the legal framework in which religion is approached. Coverage proceeds from the principle of religious freedom through the rights and contractual obligations of religious communities; international, transnational, and regional law effects; and the legal parameters affecting the influence of religion in politics and public life. Also covered are legal positions on religion in such specific fields as church financing, labour and employment, and matrimonial and family law. A clear and comprehensive overview of relevant legislation and legal doctrine make the book an invaluable reference source and very useful guide. Succinct and practical, this book will prove to be of great value to practitioners in the myriad instances where a law-related religious interest arises in Spain. Academics and researchers will appreciate its value as a thorough but concise treatment of the legal aspects of diversity and multiculturalism in which religion plays such an important part.

Book Protection and Promotion of Freedom of Religions and Beliefs in the European Context

Download or read book Protection and Promotion of Freedom of Religions and Beliefs in the European Context written by Luca Paladini and published by Springer Nature. This book was released on 2023-09-30 with total page 438 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book offers an in-depth analysis of a fundamental human freedom and a cornerstone of democracy: the Freedom of Religions or Beliefs (FoRB). The book focuses on the legal protection and promotion of FoRB in Europe because, in this context, exercising this right goes beyond a mere internal positioning in terms of legislation; rather, it is influenced by international and supranational case law, as well as the promotional activities of selected non-state subjects of international law. The content is divided into three sections: Part I on the European Convention of Human Rights, Part II on the EU, and Part III on other international actors. The first two Parts examine FoRB in its systematic aspects and “day-to-day” aspects. In contrast, the third Part highlights the promotional activities carried out by the Holy See, the ILO, the Council of Europe (“beyond the Strasbourg Court”), and the OSCE to promote, recommend or otherwise support it. Overall, the volume highlights how the exercise of FoRB can be ensured via international and supranational legal protection (both normative and judicial) and via promotional activities aimed at encouraging and helping states guarantee tolerance and pluralism in their national legislation. The 16 main chapters offer a broad overview of the topic under investigation. Each contribution can be seen as a stand-alone study and, simultaneously, as a link in a chain of legal analysis that connects multiple FoRB-focused questions. The book offers a valuable tool for all readers with an academic or professional interest in FoRB and those who have to address the issue of how to protect this freedom. It is intended not only for academics who work in the field of law but also for legal practitioners (judges, lawyers, diplomats), human rights advocates, members of religious and spiritual communities, policymakers and students.

Book Jerusalem Afflicted

Download or read book Jerusalem Afflicted written by Ken Tully and published by Routledge. This book was released on 2019-09-19 with total page 152 pages. Available in PDF, EPUB and Kindle. Book excerpt: On Good Friday, 1626, Franciscus Quaresmius delivered a sermon in the Church of the Holy Sepulcher in Jerusalem calling on King Philip IV of Spain to undertake a crusade to ‘liberate’ the Holy Land. Jerusalem Afflicted: Quaresmius, Spain, and the Idea of a 17th-century Crusade introduces readers to this unique call to arms with the first-ever edition of the work since its publication in 1631. Aside from an annotated English translation of the sermon, this book also includes a series of introductory chapters providing historical context and textual commentary, followed by an anthology of Spanish crusading texts that testify to the persistence of the idea of crusade throughout the 17th century. Quaresmius’ impassioned and thoroughly reasoned plea is expressed through the voice of Jerusalem herself, personified as a woman in bondage. The friar draws on many of the same rhetorical traditions and theological assumptions that first launched the crusading movement at Clermont in 1095, while also bending those traditions to meet the unique concerns of 17th-century geopolitics in Europe and the Mediterranean. Quaresmius depicts the rescue of the Holy City from Turkish abuse as a just and necessary cause. Perhaps more unexpectedly, he also presents Jerusalem as sovereign Spanish territory, boldly calling on Philip as King of Jerusalem and Patron of the Holy Places to embrace his royal duty and reclaim what is rightly his on behalf of the universal faithful. Quaresmius’ early modern call to crusade ultimately helps us rethink the popular assumption that, like the chivalry imagined by Don Quixote, the crusades somehow died along with the middle ages.

Available in PDF, EPUB and Kindle. Book excerpt: New forms of religious diversity have emerged that demand specific policies from the state, putting pressure on the established practices of religious governance. European societies have been a testing ground for many of these changes, but for decades Canada has been pioneering the management of diversity, thus offering interesting similarities and contrasts with the former. This book deals with the diverging routes of political secularization in Europe and Canada, the patterns of religious governance, the practices for accommodating the demands of religious minorities concerning their legal regulation, the management of public institutions, and the provision of social services.

Book The Routledge International Handbook of Religious Education

Download or read book The Routledge International Handbook of Religious Education written by Derek Davis and published by Routledge. This book was released on 2013 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: How and what to teach about religion is controversial in every country. The Routledge International Handbook of Religious Education is the first book to comprehensively address the range of ways that major countries around the world teach religion in public and private educational institutions. It discusses how three models in particular seem to dominate the landscape. Countries with strong cultural traditions focused on a majority religion tend to adopt an "identification model," where instruction is provided only in the tenets of the majority religion, often to the detriment of other religions and their adherents. Countries with traditions that differentiate church and state tend to adopt a "separation model," thus either offering instruction in a wide range of religions, or in some cases teaching very little about religion, intentionally leaving it to religious institutions and the home setting to provide religious instruction. Still other countries attempt "managed pluralism," in which neither one, nor many, but rather a limited handful of major religious traditions are taught. Inevitably, there are countries which do not fit any of these dominant models and the range of methods touched upon in this book will surprise even the most enlightened reader. Religious instruction by educational institutions in 53 countries and regions of the world are explored by experts native to each country. These chapters discuss: Legal parameters in terms of subjective versus objective instruction in religion Constitutional, statutory, social and political contexts to religious approaches Distinctions between the kinds of instruction permitted in elementary and secondary schools versus what is allowed in institutions of higher learning. Regional assessments which provide a welcome overview and comparison. This comprehensive and authoritative volume will appeal to educators, scholars, religious leaders, politicians, and others interested in how religion and education interface around the world.
