Nacido el 21 de abril de 1906 en Viena, de 1924 a 1928 estudió Derecho en Graz y se doctoró en 1928. Estudió Derecho Romano con Steinwenter, y en Munich fue discípulo del gran romanista Leopold Wenger con quien trabajó sobre problemas fundamentales entre el Derecho Privado y el Derecho Procesal Civil. En 1931 consiguió la venia docendi en Derecho Romano y Derecho Civil. En 1932 fue nombrado profesor de la Universidad de Münster de Derecho Romano y Civil. En 1959 se trasladó como profesor a Hamburgo, habiendo también desempeñado cátedra en la Universidad de Salzburgo, de donde fue nombrado profesor honorario. Impartió cursos y conferencias en las más importantes universidades del mundo. Su producción científica es importantísima, tanto por la cantidad como por la calidad e influencia en esta rama del derecho. Entre las publicaciones más importantes destacan su famoso Derecho Privado Romano, con primera edición en 1955 en dos tomos y con numerosas ediciones posteriores. La influencia de sus obras y de sus sugerencias ha sido tan extensa y profunda que puede afirmarse que Kaser ha sido el maestro de todos los romanistas del mundo. Además, articula las luchas prácticas con las investigaciones sobre el gobierno colectivo de los recursos naturales o de la información y designa formas democráticas nuevas que aspiran a tomar el relevo de la representación política y del monopolio de los partidos. Esta emergencia de lo común en la acción reclama un trabajo de clarificación en el pensamiento. El sentido actual de lo común se distingue de los numerosos usos que se ha dado a esta noción, ya sean filosóficos, jurídicos o teológicos: bien supremo de la ciudad, universalidad de esencia, propiedad inherente a ciertas cosas, incluso alguna vez el fin perseguido por la creación divina. Pero hay otro hilo que vincula lo común, no a la esencia de los hombres o a la naturaleza de las cosas, sino a la actividad de los hombres mismos: sólo una práctica de puesta en conjunto puede decidir qué es “común”, reservar ciertas cosas al uso común, producir determinadas reglas capaces de obligar a los hombres. En este sentido, lo común reclama una nueva institución de la sociedad por ella misma: una revolución.

La obra de "Rómulo y Remo", "La Monarquía", "La República, "El Imperio" (sus emperadores y su ocaso); cómo surge el "Derecho Romano", y "el uso del latín en el derecho". Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.
