These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. Book excerpt: La herencia normativa y el momento de optimismo histórico en el que se redacta la LO 1/1079, General Penitenciaria, hacen que nuestro sistema penitenciario vaya más lejos que sus antecesores. Primero, porque su diseño de cumplimiento trata de adaptarse a las necesidades de cada interno, respondiendo a lo que se conoce como sistema de individualización científica. Segundo, porque en función de lo anterior, el régimen de cumplimiento se somete al tratamiento penitenciario, que se convierte así en el núcleo de la ejecución de la pena de prisión. A pesar de no tratarse de un sistema perfecto, lo cierto es que hasta hace unos años Derecho Penal y Derecho Penitenciario caminaban en una misma dirección. Sin embargo, las reformas penales que se vienen sucediendo desde el año 2003 provocan tensiones continuas entre ambos cuerpos normativos. El presente trabajo repasa tanto los fallos internos de nuestro sistema penitenciario, como la oleada normativa de carácter penal que se viene produciendo. De este modo, se muestra cómo las reformas llevadas a cabo no inciden en los verdaderos fallos del sistema penitenciario, sino que se obcecan en cercenar la potencialidad de lo que probablemente constituye el elemento más valioso del sistema: el principio de flexibilidad y las posibilidades que ofrece en cuanto a la individualización del cumplimiento. En este contexto, se apela a la responsabilidad de los juristas, como pieza clave en el organigrama de Instituciones Penitenciarias en tanto que miembros de los equipos técnicos. Más allá de la burocratización que el sistema impone, y que sirve para consolidar el status quo implantado, han de recordar en cada una de sus actuaciones cuáles son los principios rectores de la institución para la que trabajan, la primacía de los mismos conforme a una normativa que, hoy por hoy, continúa vigente, y la relevancia de que la situación individualizada de los internos sea lo determinante en la decisión administrativa que finalmente se adopte.
