Book excerpt: The four decades long ideological-based insurgencies and conflict in the Kabul River Basin (KRB) have seriously hampered the relations and foreign policies of both Afghanistan and Pakistan. Consequently, it restricts them to solve various bilateral issues including transboundary waters. This lack of cooperation over shared water resources is one of the barriers to achieve inclusive and sustainable development. Additionally, it has contributed to the prevailing anarchic situation where each country does what it wants. The absence of a formal water-sharing mechanism coupled with poor water management practices within both the riparian counties are resulting various flow and administration-related challenges. Moreover, these challenges are further exacerbated by regional changes in social, political, environmental and economic systems. The scholarly literature suggests that an analytical transboundary water governance framework is essential to address the challenges of water politicisation and securitisation, quality degradation and quantity reduction. Additionally, the literature rarely integrates (a) a multi-level approach, (b) an institutional approach (c) an inclusive development approach, or (d) accounts for the uses of different types of water and their varied ecosystem services for improved transboundary water governance. To enhance human wellbeing and achieve inclusive and sustainable development in the KRB this research indicates that it is essential to: (1) defrost frozen collaboration; (2) bypass border dispute; (3) use biodiversity and ecosystem services approach; (4) address existing and potential natural and anthropogenic challenges; (5) remove contradictions in the policy environment; (6) combat resource limits and dependence by promoting collaboration on long-term cost effective solutions; and (7) enhance knowledge and dialogue on inclusive development.

Sobre esta premisa, en la presente obra se esboza una teoría principialista de la pena. Pero frente a las comprensiones mayoritarias, preocupadas por la idea –que apenas por la praxis– de la prevención, la teoría esbozada se interesa primeramente por «la relación de proporcionalidad entre el desvalor del comportamiento… y la pena», y de la mano de la teoría de la ponderación, persigue una mayor racionalización de esta acepción del principio de proporcionalidad, así como de su ponderación con ulteriores principios, en particular, con los de prevención especial y general. En relación con el principio de reeducación y reinserción social, se subraya la necesidad de diferenciar estructuralmente entre derechos de defensa y de prestación, y sobre esta base, las contradicciones del TC, que niega su estatus de derecho fundamental sobre sucesivas peticiones de principio. La importancia atribuida en la obra a la base empírica de las razones no lleva a obviar el principio de prevención general, si bien se sugiere racionalizar su peso a efectos de ponderación. Pues no deja de ser llamativo que la teoría de una institución que incide tan drástica y tangiblemente sobre tantos miles de personas, se asiente sobre principios que se sustraen «en su mayor parte a la verificación empírica». Finalmente, el modelo de ponderación se cierra con las denominadas reglas de la pena. En este sentido, reglas como la recogida en el art. 15 CE, que proscribe las «penas o tratos inhumanos», evidencian hasta qué punto la teoría de la pena necesita de desarrollos, pero de otros desarrollos que permitan, entre otras cosas, discriminar entre las penas inhumanas y las válidas conforme a la Constitución Española. Algo particularmente urgente dadas las derivas punitivas del legislador.

At its centre is a rejection of the death penalty as excessive, unnecessary, and pointless. Beccaria is deservedly regarded as the founding father of modern criminal-law reform, yet he was not the first to argue for the abolition of the death penalty. Against the Death Penalty presents the first English translation of the Florentine aristocrat Giuseppe Pelli's critique of capital punishment, written three years before Beccaria's treatise, but lost for more than two centuries in the Pelli family archives. Peter Garnsey examines the contrasting arguments of the two abolitionists, who drew from different intellectual traditions. Pelli was a devout Catholic influenced by the writings of natural jurists such as Hugo Grotius, whereas Beccaria was inspired by the French Enlightenment philosophers. While Beccaria attacked the criminal justice system as a whole, Pelli focused on the death penalty, composing a critique of considerable depth and sophistication. Garnsey explores how Beccaria's alternative penalty of forced labour, and its conceptualisation as servitude, were embraced in Britain and America, and delves into Pelli's voluminous diaries, shedding light on Pelli's intellectual development and painting a vivid portrait of an Enlightenment man of letters and of conscience. Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. Credit Nation presents a new vision of American economic history, one where credit markets and liquidity were prioritized from the outset, where property rights and slaves became commodities for creditors' claims, and where legal institutions played a critical role in the Stamp Act crisis and other political episodes of the founding period.
