Book excerpt: El deporte tradicionalmente se ha configurado bajo parámetros ajenos al lucro y la obtención de ganancias, primando de este modo su práctica y organización recreativa y amateur, realidad que sin embargo no puede sostenerse hoy en día, ante la existencia de una importante evolución hacia su desarrollo sustentado en aspectos patrimoniales, que al provocar la profesionalización tanto en sus estructuras como en la práctica del fenómeno deportivo, altera sus clásicos criterios, obligando a la creación de reglas jurídicas conforme a los nuevos tiempos. Esta realidad actual del desarrollo de la práctica deportiva justifica la necesidad de abordar un estudio como el presente sobre el ámbito jurídico-privado patrimonial del deporte, en el que se procede al análisis de aspectos y materias tan trascendentes y actuales como la capacidad de obrar para concertar relaciones contractuales deportivas, el contrato de prestación de servicios deportivos y sus particularidades conforme a su naturaleza civil o laboral, el régimen aplicable a la explotación de los derechos de imagen de los deportistas, la procedencia del pago del denominado derecho de formación, los contratos de seguros deportivos, el régimen del contrato de los agentes deportivos, la publicidad y el patrocinio en el deporte, las sociedades anónimas deportivas, la incidencia de las normas concursales en el deporte, la cesión de la explotación de los derechos televisivos y la responsabilidad extracontractual en el deporte, lográndose con ello además llenar un vacío existente en la bibliografía de la materia, que adolecía de un estudio completo e íntegro de estas características. El autor, Eduardo de la Iglesia Prados, Profesor Contratado Doctor de Derecho civil en la Universidad de Sevilla, acreditado al Cuerpo Docente de Profesores Titulares de Universidad, y miembro del Comité Andaluz de Disciplina Deportiva, ha publicado múltiples y variados estudios en las revistas especializadas en la materia, así como ha sido ponente en diversas Jornadas, Congresos, Seminarios y clases de Máster organizadas tanto por Universidades, Asociaciones deportivas, Colegios de Abogados o entes privados.

Peter Suber has been a leading advocate for open access since 2001 and has worked full time on issues of open access since 2003. As a professor of philosophy during the early days of the internet, he realized its power and potential as a medium for scholarship. As he writes now, “it was like an asteroid crash, fundamentally changing the environment, challenging dinosaurs to adapt, and challenging all of us to figure out whether we were dinosaurs.” When Suber began putting his writings and course materials online for anyone to use for any purpose, he soon experienced the benefits of that wider exposure. This need for "sustainable development" is and more by the responsible parties. Moreover, in the being recognised more search for solution strategies the realisation is gaining ground that tourism must be viewed as a worldwide phenomenon whose development must be co-ordinated in a co-operative effort spanning regions and continents. That the preservation of biological diversity also requires global co operation has been confirmed by over 170 countries which have already acceded to the "Convention on Biological Diversity". It is thus an important task to provide the foundations for joint action. Germany, one of the largest source countries of international tourism, must feel particularly obligated in this regard. The report published here is the result of a research project com missioned by the German Federal Agency for Nature Conservation. The study pursued and examined the thesis that the Convention on Biological Diversity be used as a central instrument for arriving at international principles and regulations for combining nature conservation and tourism which could lead to a sustainable development of tourism. To further the discussion, the authors brought the study to a logical conclusion by working out a proposal for a "tourism protocol" additional to the existing Convention on Biodiversity. Such a protocol additional to the Convention would entail the stipulation of internationally binding implementation and regulations for achieving sustainable tourism.
