Book excerpt: El 1 de julio de 2006 entró en vigor para España el llamado Protocolo de Vilna, de 3 de junio de 1999, que modifica el Convenio relativo a los Transportes Internacionales por Ferrocarril (COTIF). De entre las novedades más relevantes destaca la sustitución del anterior Reglamento relativo al transporte internacional ferroviario de vagones de particulares (RIP) por las Reglas Uniformes relativas a los contratos de utilización de vehículos en tráfico internacional por ferrocarril (CUV – Apéndice D del Convenio). A su amparo se elaboró el llamado Contrato Uniforme de Utilización de vagones, un acuerdo de naturaleza jurídico-privada que, gracias a la participación de más de 600 empresarios que reúnen alrededor de 700.000 vagones de mercancías, se ha convertido en uno de los ejemplos más destacados de una regulación privada praeter legem en Europa. Desde su entrada en vigor conforma, junto con las Reglas Uniformes CUV, el marco jurídico en el que mayoritariamente se desarrolla la utilización de vagones de mercancías por parte de quien no es su poseedor registral. Sobre la base del tenor de sus cláusulas, el texto analiza la naturaleza jurídica del propio Contrato Uniforme y la del concreto contrato de utilización del vagón que se celebre a su amparo, las obligaciones de las partes y la responsabilidad que incumbe a cada una de ellas en caso de daños en el vagón o causados por éste a la contraparte en el contrato o a terceros.
