Book excerpt: La falsificación de marcas se ha convertido en un fenómeno de dimensión internacional que alcanza en la actualidad una especial gravedad, afectando no sólo a los titulares de esos derechos de propiedad industrial sino también a la sociedad en su conjunto. La globalización de la economía y, con ello, de la falsificación de marcas, exigen una respuesta también global al fenómeno. Sin embargo, todos los intentos internacionales de armonizar la protección penal de las marcas han terminado fracasando, requiriendo la aportación de nuevos argumentos y sensibilidades. La territorialidad de la ley penal supone un obstáculo a la persecución de estos delitos, resultando necesario un mayor nivel de cooperación policial y judicial en el ámbito internacional. Esta obra cubre tanto los aspectos pre-procesales de la investigación criminal como los del propio proceso penal seguido en los delitos de usurpación de marcas, analizando, entre otras cuestiones, la dimensión económica y la internacionalización de la falsificación de marcas, la delincuencia organizada presente en esta materia, los organismos internacionales con competencia en la persecución de estos delitos en el ámbito nacional e internacional, los intentos internacionales de homogeneizar la protección penal, los instrumentos internacionales en la lucha contra este fenómeno, la tipificación penal de la infracción y el proceso penal seguido por falsificación de marcas, el régimen especial de medidas aduaneras contra las falsificaciones establecido en el Reglamento (UE) núm. 608/2013, incluyendo una referencia a las mercancías en tránsito, así como la necesidad de reforzar los instrumentos procesales en orden a la defensa penal contra la falsificación de marcas.
