Book excerpt: En la primera parte de este volumen se estudia la relación entre libertad de conciencia e identidad personal, mostrando la protección jurídica reforzada que el Derecho dispensa al derecho consagrado en el art. 16 CE en su doble vertiente como libre formación de la conciencia (identidad personal y derechos consagrados en el art. 18 CE) y como libertad de expresión de palabra y obra, de los que es titular la persona, como sujeto activo en el segundo caso, como sujeto pasivo en el primero. Derecho a la educación y derechos de libertad de enseñanza, derecho a la información y libertad de expresión, derecho a una zona sustraída a la invasión del Derecho, relación entre moral y Derecho y derecho a la objeción de conciencia se estudian desde esa doble perspectiva. En la segunda parte la atención se vuelca sobre otro de los contenidos del derecho de libertad de conciencia: el derecho de asociación sobre la base de convicciones comunes, sean estas religiosas, ideológicas, culturales o una mezcla de unas y otras. El protagonismo les va a corresponder tanto a las confesiones religiosas como a las minorías culturales, en especial las emergentes de la inmigración, en tanto que expresión de identidades colectivas que deben estar al servicio de las identidades individuales y del derecho a la diferencia siempre que éste no colisione con los valores comunes a todos las personas y colectivos que forman parte de la comunidad política. En todos los casos se estudia cuál es de iure condito y cuál deba ser de iure condendo la protección jurídica del derecho de libertad de conciencia como derecho de libertad de convicción y cuales las exigencias de la laicidad del ordenamiento como garantía eficaz de esa protección.

In Without Criteria, Steven Shaviro proposes and explores a philosophical fantasy: imagine a world in which Alfred North Whitehead takes the place of Martin Heidegger. What if Whitehead, instead of Heidegger, had set the agenda for postmodern thought? Heidegger asks, “Why is there something, rather than nothing?” Whitehead asks, “How is it that there is always something new?” In a world where everything from popular music to DNA is being sampled and recombined, argues Shaviro, Whitehead's question is the truly urgent one. Without Criteria is Shaviro's experiment in rethinking postmodern theory, especially the theory of aesthetics, from a point of view that hearkens back to Whitehead rather than Heidegger. In working through the ideas of Whitehead and Deleuze, Shaviro also appeals to Kant, arguing that certain aspects of Kant's thought pave the way for the philosophical “constructivism” embraced by both Whitehead and Deleuze. Kant, Whitehead, and Deleuze are not commonly grouped together, but the juxtaposition of them in Without Criteria helps to shed light on a variety of issues that are of concern to contemporary art and media practices.
