El estudio y comparación de las normas españolas y argentinas es uno de los caminos para encontrar tales respuestas. El presente trabajo tiene un doble objetivo; en primer lugar quiere poner de manifiesto de forma concisa la regulación relativa a la protección de datos en España y Argentina; en segundo lugar quiere visualizar las carencias de uno y otro ordenamiento jurídico. Parece lógico deducir que de ello se obtiene la que ha de ser tarea del legislador y de la jurisprudencia. En esa labor se requiere de forma inexorable la consulta doctrinal, porque de ella se extraen los objetivos, la teleología de toda regulación. Pero la comparación de legislaciones nacionales también plantea dificultades, singularmente de homogeneización en el análisis, a la vez que la posibilidad de perderse en un mar normativo o de casuística. Quizás por lo expuesto nuestra pretensión ha sido prudente y se analiza y compara la normativa de inmediato desarrollo constitucional y legislativo. Dada la existencia de la evolución tecnológica y la necesidad de su regulación jurídica con carácter universal, la presente obra tiene por objeto conocer las regulaciones relativas a protección de datos de carácter personal en España y Argentina, y en segundo lugar, aportas ideas para una futura regulación. These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.

In recent decades, local governments in Europe have increasingly found themselves under pressure from a multitude of new challenges, such as demographic change, climate change, fiscal austerity policies, digitization, the demand for more citizen participation in local affairs, and the migration crisis in some of them, to name just a few. Consequently, a wave of political and administrative reforms to address these challenges, pressures and problems, has changed local governance in many countries. In part, these changes were the result of reform policies introduced by national and state governments, often triggered by austerity policies, which has become an overwhelming reality for Spanish local governments that have been forced to introduce innovations in local governance. This book aims to give an account of these innovations in local governance in Spain. This book considers the local political-administrative structure in its dimensions, focusing on the analysis of its party system, electoral competition and political behavior in the local arena, as well as on local finances, all of which are determining elements in urban and rural governance processes. On the occasion of the recent crisis unleashed by Covid-19, the book will also deal with local governance in crisis situations. The book will also contextualize local governance processes in Spain in relation to the trends in local governance observed in other European countries.
