En primer lugar, se analiza como el agua se constituye como derecho humano y se observa sus componentes economico, social y cultural. Posteriormente, se estudia la costumbre como fuente fundamental en el goce de los derechos humanos de los indigenas y la configuracion de una dimension colectiva cuando se enmarcan dentro de las sociedades multiculturales contemporaneas. Por ultimo, se construye la fundamentacion de la hipotesis principal del trabajo concluyendo que la proteccion de este derecho podria tener viabilidad de acuerdo al marco otorgado por la Convencion Americana sobre Derechos Humanos, en particular de acuerdo a la interpretacion de sus articulos 21, 4.1 y 3 a la luz del articulo 29 del mismo tratado."
