Book excerpt: El presente trabajo de investigacion formula una construccion juridica dentro del marco del Derecho Internacional de los Derechos Humanos para proteger jurisdiccionalmente el derecho humano al agua de los pueblos indigenas en su dimension colectiva a traves de la Corte Interamericana de Derechos Humanos. En primer lugar, se analiza como el agua se constituye como derecho humano y se observa sus componentes economico, social y cultural. Posteriormente, se estudia la costumbre como fuente fundamental en el goce de los derechos humanos de los indigenas y la configuracion de una dimension colectiva cuando se enmarcan dentro de las sociedades multiculturales contemporaneas. Por ultimo, se construye la fundamentacion de la hipotesis principal del trabajo concluyendo que la proteccion de este derecho podria tener viabilidad de acuerdo al marco otorgado por la Convencion Americana sobre Derechos Humanos, en particular de acuerdo a la interpretacion de sus articulos 21, 4.1 y 3 a la luz del articulo 29 del mismo tratado."
