Como esa amalgama de infinidad de normas sancionadoras estatales, autonómicas y hasta locales está lejos de formar un conjunto coherente y armonioso, es la jurisprudencia -junto con la doctrina- la que viene dándoles estructura y un sentido unitario.Este libro recoge sentencias sobre sanciones administrativas relativas a todos los sectores, incluido -por supuesto- el tributario, pero también la fecunda jurisprudencia de la Sala de lo Militar del Tribunal Supremo e incluso se ha ido más allá de las sanciones propiamente administrativas para analizar, por ejemplo, las numerosas sentencias sobre sanciones impuestas por el CGPJ.Los autores han procurado que las sentencias aparezcan con referencia al asunto concretamente resuelto, con indicación del sector en que la sanción se produjo y de los hechos, hasta con alusión de los que parecen puramente anecdóticos y, así, se habla del pub bésame mucho, la Princesa Diana de Gales y Cindy Crawford, del banderillero entusiasta, el torero displicente, el benemérito onanista, el presidente de club de fútbol forofo, los auditores de Gescartera o la central nuclear de Vandellós I.Sin detrimento del rigor y seriedad de la obra y de la gravedad que los casos requieren, se presenta la jurisprudencia en su salsa para hacerla más sabrosa y digerible.

Book excerpt: The Max Planck Handbooks in European Public Law series describes and analyses the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. Book excerpt: The aim of the book is to resolve the question of whether multiple sanctioning systems are contrary to the ne bis in idem under the regulation provided by Protocol 7 to the ECHR and the EU Charter of Fundamental Rights. The first part is a comparative study regarding the lawfulness of multiple sanctioning systems under the ne bis in idem, studying the evolution and the current state of the case law of the United States Supreme Court, the Canadian Supreme Court, the European Court of Human Rights (ECtHR), and the Court of Justice of the European Union (CJEU). The second part of the book critically analyses three problems with the case law of the ECtHR and the CJEU. Part three deals with reconceptualizing the prohibition of multiple punishment and the prohibition of multiple prosecutions. Finally, the fourth part addresses other possible protections against multiple sanctioning systems. Two other safeguards that limit multiple sanctioning systems are the prohibition of disproportionate sanctions and the right to be tried within a reasonable time.

These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.
