Book excerpt: En 1975 apareció en Caracas, editado por la Universidad Central de Venezuela, el tomo I de nuestro Derecho administrativo (463 pp.), texto que era el anuncio de un proyecto muy ambicioso de una obra de largísimo alcance sobre la disciplina, el cual, sin embargo, precisamente por la intensísima actividad académica que he tenido en los treinta largos años han pasado, no pude continuar en su momento. Pero nunca es tarde para la labor creadora, y menos cuando se trata de las actividades académicas que se realizan con gran entusiasmo, como es precisamente la que representa la obra que ahora acometo, editada en Bogotá por la Universidad Externado de Colombia y la Universidad Central de Venezuela; obra mediante la cual he reformulado totalmente el viejo proyecto. Se trataba, sin duda, una tarea que tenía pendiente, pero que, por lo demás, considero que ahora la cumplo en el momento que debía ocurrir, en la cual tengo la oportunidad de recoger los frutos de las más de cuatro décadas de investigación y de enseñanza de esta disciplina, tanto en pre como postgrado. Ha sido una fructífera actividad académica que desde 1963 he tenido la fortuna de desarrollar en las muy queridas Universidades a cuyo Claustro he tenido y tengo el privilegio de pertenecer, tanto en Venezuela (Universidad Central de Venezuela, Universidad Católica Andrés Bello, Universidad de Los Andes, Universidad del Zulia y Universidad Católica del Táchira) y en Colombia (Universidad Externado de Colombia, Pontificia Universidad Javeriana, Universidad Colegio Mayor Nuestra Señora del Rosario) como en Europa (Universidad de Cambridge, Universidad de París II, Universidad Carlos III de Madrid). El tiempo pasa siempre dejando sus huellas, y en relación con esta obra, produjo la necesidad de cambiar tanto el proyecto original como el contenido mismo de aquél tomo I del Derecho administrativo que, en su momento, básicamente había dedicado al estudio de lo que en su momento califique como los supuestos fundamentales de la disciplina. En sí mismo, aquél era un tema inagotable que invadía los campos de las instituciones políticas y constitucionales y del propio derecho constitucional, por lo que puede decirse que al desarrollo de cuanto escribí en aquél tomo I, fue que dediqué buena parte mi actividad académica posterior, al editar el libro Instituciones Políticas y Constitucionales, en aproximaciones sucesivas hasta llegar a la edición en 7 tomos realizada entre 1996 y 1998, por la Editorial Jurídica Venezolana y la Universidad Católica del Táchira (4.589 pp.). Esa edición había sustituido la de 1985 (en 2 tomos, 1.488 pp.) la cual había sustituido la de 1982 (713 pp.), y en su presentación yo mismo apunté, sin duda equivocadamente, como el tiempo lo demostró, que "con estos trabajos cierro, por ahora, un capítulo de la incursión de un administrativista en los predios de la ciencia política y del derecho constitucional"; agregando que "Tengo proyectado volver rápidamente a mi campo específico, y desde ya trabajo en una obra sobre Instituciones de derecho administrativo que espero saldrá pronto a la luz pública". No fue así sin embargo, y sólo ha sido después de casi una década que he podido acometer la tarea. Es decir, no sólo no pude en ese momento volver a mis predios iniciales, sino que la propia crisis del sistema político venezolano a finales de los ochenta y los cambios políticos y constitucionales que ocurrieron en Venezuela a partir de los noventa, así como mi propia participación como constituyente en la Asamblea Nacional Constituyente de 1999, me obligaron de nuevo a posponer aquella tarea anunciada, y me exigieron más bien profundizar el tema constitucional, lo que condujo, en 2004, a la edición de la obra La Constitución de 1999. Derecho constitucional venezolano, publicada en 2 tomos (1.349 pp.) por la Editorial Jurídica Venezolana. Pero el tiempo llegó para acometer la tarea pendiente e inconclusa, y gracias al estímulo intelectual que significó la propuesta de la Universidad Externado de Colombia, ahora el sale a la luz esta obra de Derecho administrativo, en cinco tomos iniciales, que son los que están completamente estructurados, a los que espero seguirán otros. Por lo pronto, respecto de los cinco primeros tomos ya definitivamente estructurados, en los mismos he querido estudiar lo siguiente: en el tomo I, los principios fundamentales del derecho público, tanto administrativo como constitucional (Introducción general), la Administración Pública y el derecho administrativo (Primera parte) y la personalidad jurídica en el derecho administrativo (Segunda parte); en el tomo II, los aspectos sustanciales de la organización administrativa, particularmente de la Administración Pública nacional (Tercera parte) y de las Administraciones Públicas estadales y municipales (Cuarta parte); en el tomo III, las actividades del Estado y la actividad administrativa (Quinta parte) y el procedimiento administrativo (Sexta parte); en el tomo IV, el acto administrativo (Séptima parte) y los contratos del Estado (Octava parte), y en el tomo V, el control judicial de la actividad administrativa, es decir, el contencioso administrativo. Los tomos subsiguientes se destinarán a estudiar los cometidos estatales, los recursos para su desempeño (administración financiera, bienes públicos, estatuto de la función pública), la participación de los administrados en las tareas administrativas, la responsabilidad de la Administración Pública, y el régimen jurídico administrativo de la economía, de la ordenación territorial y del urbanismo. Sin duda, se trata de nuevo de una obra ambiciosa, pero que la inicio con cinco tomos ya estructurados, lo que asegura su cristalización; obra que, estoy seguro, no sólo era esperada por muchos alumnos, colegas de cátedra y amigos, sino principalmente por mi mismo. De allí el entusiasmo con que la acometo, gracias a Dios siempre en compañía de Beatriz, con los mismos bríos intelectuales y vitales con los que asumí la redacción de aquél mi primer libro en estos campos, en aquellos siempre recordados días paisínos de comienzos de los años sesenta, sobre Las Instituciones Fundamentales del derecho Administrativo y la Jurisprudencia Venezolana, (494 pp.), obra también editada por la Universidad Central de Venezuela (1964). Cuarenta años entre una y otra obra, para una vida ciertamente es mucho, pero en realidad no es nada cuando a pesar de ello, se siente que se tiene la vida por delante! They are also able, in the success of their efforts to mitigate the educational impact of the pandemic, to create better futures, as the result of the innovations they can generate. This challenges the view of universities as "ivory towers" being isolated from the surrounding environment and detached from local problems. As they reached out to schools, universities not only generated clear and valuable innovations to sustain educational opportunity and to improve it, this process also contributed to transform internal university processes in ways that enhanced their own ability to deliver on the third mission of outreach

Liars are saying that COVID-19 is a hoax. They are claiming that vaccines cause autism. They are lying about public officials and about people who aspire to high office. They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing. As Sunstein contends, we are allowing far too many lies, including those that both threaten public health and undermine the foundations of democracy itself.
