Book excerpt: Iniciando, tras mi paso por la función de juez de instrucción y magistrada de lo penal, un estudio jurídico profundo de la figura de las medidas cautelares, se me hace evidente que no son estas las que respetan la Constitución si no que existen en función de tal Norma. Ello supone un giro radical en la perspectiva jurídica de tal figura que debe entenderse como parte del contenido esencial del derecho fundamental a la libertad, formalizando y construyendo el ámbito del mismo, y, por ende, al necesario estudio de tal derecho fundamental y cerrando el círculo que conforma nuestro sistema jurídico. Para alcanzar tal cometido el presente estudio, entendiendo que los derechos fundamentales se estructuran como elementos sociales vivos, debe partirse de cada una de las realidades históricas que han llevado a la configuración, a través de la declaración de los derechos del hombre como hito estructural, actual de los derechos fundamentales de nuestra Constitución. Desde tal punto de partida también debemos entender que la figura de las medidas cautelares se configura en distintas formas cuyo común denominador se establece en la jurisdiccionalidad de su imposición.

Tienen como meta contribuir a que los seres humanos puedan alcanzar con su esfuerzo, pero con la ayuda de todos, el máximo nivel posible de humanización, es decir, el mayor desarrollo posible de todas las dimensiones que configuran su dignidad. Para ello actúan como elementos de racionalización del poder tanto público como privado, delimitando y regulando su organización, así como su ejercicio. Exigen que el poder omita aquellas conductas que puedan amenazarlos o vulnerarlos, que cumpla con las prestaciones necesarias para su realización efectiva y que los dote, de las garantías adecuadas para lograr sus fines. El proceso no podría, o no debería, estar de espaldas a ese propósito. Por eso se sostiene que, para garantizar la vigencia real de la dignidad del ser humano, de los valores superiores, de los derechos fundamentales y del ordenamiento jurídico en su conjunto, en suma, de la paz social en justicia, resulta necesario reconocer y garantizar los derechos que conforman lo que comúnmente denominamos debido proceso. Pero, al mismo tiempo, se hace indispensable reivindicar su calidad de derecho fundamental con todas las consecuencias que se derivan de ello y rescatar aquella concepción que lo vincula con la satisfacción de un ideal de justicia y nos permite hablar del derecho fundamental a un proceso justo: más humano, más solidario, más comprometido con la realidad donde se desarrolla, y sobre todo con su transformación, especialmente con los valores superiores, entre ellos y principalmente con la justicia".

It begins with the composition of the Commission and Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions and reports by the Commission and historic correspondences and decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the "Velasquez Rodriguez" case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social and Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. The "Inter-American Yearbook on Human Rights" is completely bilingual (English and Spanish).
