Book The Law of Shipbuilding Contracts

Download or read book The Law of Shipbuilding Contracts written by Simon Curtis and published by Taylor & Francis. This book was released on 2020-04-29 with total page 634 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law of Shipbuilding Contracts examines the principles of English contract law as these apply to shipbuilding. The leading text on shipbuilding and marine construction, widely used by the global maritime community, this new edition is updated to account for the "long tail" effects of the global economic crisis on the sector. The authors provide expert analysis on the key shipbuilding contract forms, including sections dealing with agreements ancillary to the shipbuilding contract and ship conversion contracts, together with — for the first time — contracts for the construction of offshore oil and gas vessels and units. The new edition has been comprehensively updated, including commentary on recent High Court decisions on shipbuilding contracts and, in particular, associated refund guarantees. The contractual and legal consequences of global economic turbulence and the resultant increase in the number and size of disputes in the shipbuilding sector are discussed, alongside coverage of other contemporary regulatory and legal issues resulting from environmental pressures and the trend for "cleaner", more efficient tonnage. A comprehensive and authoritative resource, this book is essential reading for buyers and charterers of newbuilding tonnage, shipbuilders and offshore construction yards, shipbrokers, banks and other finance providers, lawyers and insurers working in the maritime and offshore oil and gas sectors, as well as students of maritime law.

Book Intercellular and Interorganellar Transfer and Communication in Biology and Medicine

Download or read book Intercellular and Interorganellar Transfer and Communication in Biology and Medicine written by Malgorzata Kloc and published by Springer Nature. This book was released on 2024 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume covers recent developments on the role, composition, and functional significance of intercellular and interorganellar transfer. It highlights the involvement of intercellular and interorganellar transfer in cell and developmental biology, differentiation, pathogen dissemination, shaping the genetic makeup of organisms, and the development of various diseases. Animals and plants evolved different communication mechanisms and transfer of molecules and organelles between cells and between organelles within the individual cells. Tunneling nanotubes (TNTs) in animals, discovered as recently as 2004, and their functional equivalent in plants, plasmodesmata, discovered over 100 years ago, are the membranous bridges that mediate the transfer of organelles, membrane patches, vesicles, DNA/RNA, and different molecules between cells. In addition, there are other means of transfer and communication between the cells, such as cytonemes, airinames, extracellular vesicles (exosomes), and others. Variations in cytoskeletal composition, morphology, modality, and connected cells suggest that these structures play a role in development, establishment of cell fate, progenitor cell differentiation, cell reprogramming, ferroptosis, generation of cancer stem cells, and various diseases. The exchange of intact membrane patches (trogocytosis) between cells of the immune system may modify the immune response. Additionally, the transfer of genetic information between nucleus and organelles and cells of different species can shape the species and evolutionary outcome. Viral and bacterial pathogens can hijack the inter-cellular transfer routes to spread more efficiently. Cell-to-cell transfer of animal and plant pathogens can also occur by the virological synapse (VS). These specialized pathogen-induced structures share similarities and differences with neurological and immunological synapses.

Book The Construction of Commercial Contracts

Download or read book The Construction of Commercial Contracts written by JW Carter and published by Bloomsbury Publishing. This book was released on 2013-01-04 with total page 509 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book adopts a principled approach to the law applied in the construction of commercial contracts. This approach is presented as part of a coherent theory of the law of contract construction which makes a unique contribution to scholarship and understanding of the most important aspect of the practice of commercial lawyers. The law is explained by reference to three stages in construction. It distinguishes the preliminary stage in which context is established, from the 'meaning' and 'application' stages of contract construction. The approach provides insights both into the practical problems that lawyers face, in particular in relation to admissibility of extrinsic evidence, and the theoretical underpinnings of the subject. The book also explains the relationship between intention and construction, and discusses general and specific rules that determine the results of construction disputes. Each chapter is introduced by statements of its objectives and the book includes simple definitions of key concepts, as well as summaries of the complex principles which comprise the law of construction. In illustrating construction principles and their application, the exposition of the law draws on the author's knowledge of Australian contract law and the influence and role of the UNIDROIT principles, CISG and the American Restatement (Second) Contracts.
