In the tradition of Zola's J'accuse, Lilia Schwarcz takes up and debunks the popular and cherished national myth of Brazil as a tolerant, open, peaceful, and racially-harmonious society. In that country's history textbooks even Brazil's centuries of slavery have been described as an ultimately benign, paternalistic order in which the races freely mixed and the cruelty of the U.S. slave experience was absent. This, Schwarcz argues, papers over centuries of racially-motivated violence, cruelty, and exploitation. These centuries of slavery under colonial and monarchical rule have left their indelible mark and are at the origins of the structural racism and oppression experienced today by Brazil's black and indigenous peoples. The book outlines the roots of Brazil's contemporary authoritarian oppression of these peoples and paints a vivid portrait of just how dire the situation is at present. Schwarcz's account also details the series of events leading to the 2018 election, demonstrating how Brazil's historical legacy of slavery and inequality, despite an appearance of democracy and tolerance, enabled the defeat of the country's social democratic left and the ascendancy of Bolsonaro's far right political movement. Book excerpt: This book discusses the designs and applications of the social systems theory (built by Niklas Luhmann, 1927–1998) in relation to empirical socio-legal studies. This is a sociological and legal theory known for its highly complex and abstract conceptual apparatus. But how to change its scale in order to study more localised phenomena, and to deal with empirical data, such as case law, statutes, constitutions and regulation? This is the concern of a wide variety of scholars from many regions engaged in this volume. It focuses on methodological discussions and empirical examples concerning the innovations and potentials that functional and systemic approaches can bring to the study of legal phenomena (institutions building, argumentation and dispute-settlement), in the interface with economy and regulation, and with politics and public policies. It also discusses connections and contrasts with other jurisprudential approaches – for instance, with critical theory, law and economics, and traditional empirical research in law. Two decades after Luhmann’s death, the 21st century has brought countless transformations in technologies and institutions. These changes, resulting in a hyper-connected, ultra-interactive world society bring operational and reflective challenges to the functional systems of law, politics and economy, to social movements and protests, and to major organisational systems, such as courts and enterprises, parliaments and public administration. Pursuing an empirical approach, this book details the variable forms by which systems construct their own structures and semantics and ‘irritate’ each other. O texto de Keeney sintetiza algumas das principais ideias que preconiza para intervir em situações de decisão, neste caso em situações de definição de políticas públicas, advogando e ilustrando a importância de basear a intervenção na eliciação dos valores do público e na sua modelação através de uma função de utilidade multiatributo. O texto de Broome pretende ilustrar os moldes em que o problema de tomada de decisões pode aparecer no âmbito da Filosofia, debruçando-se sobre um tema de longo debate entre filósofos: pode um raciocínio culminar numa ação ou apenas pode culminar numa crença? Cada um destes artigos, traduzido para a língua portuguesa, é acompanhado por um comentário de um autor português, respetivamente: Armando Mónica de Oliveira, Manuel Matos, João Clímaco e António Manuel Martins. This works contains valuable essays in three languages — English, Portuguese, and Spanish — and is a small example of the reach of Rorty’s thought and its expansion beyond the Anglo-Saxon world in only ten years after his death.
