Book The Inspection Panel of the World Bank

Download or read book The Inspection Panel of the World Bank written by Gudmundur Alfredsson and published by BRILL. This book was released on 2022-07-11 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the adoption of extensive human rights standards and their wide acceptance by States and the international community, the time has come to emphasise the implementation of these standards at both national and international levels. International financial institutions and development agencies have a special role to play in this respect, considering the influence and the resources at their disposal. Increasingly, they are acknowledging this duty, not only as a service to human rights but more so in recognition of the contribution which human rights and democracy, and so by extension good governance and accountability, make to political stability and improved economies. This volume is the result of a Workshop on the Inspection Panel which was organised in Lund by the Raoul Wallenberg Institute of Human Rights and Humanitarian Law and co-sponsored by the World Bank. Its purpose is to look for common ground in areas of mutual interest and to offer a substantive collection of ideas which can prove useful for the future work of the Inspection Panel and similar institutions. Such undertakings must include human rights education and training for the officialdom of national governments and international organisations, as well as for the individuals and groups who stand to benefit from the implementation of the international standards and monitoring exercises, where independent and impartial experts scrutinise the conduct of national and international actors.

Book The World Bank s Inspection Panel

Download or read book The World Bank s Inspection Panel written by Enrique R. Carrasco and published by . This book was released on 2008 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In September 1993, the World Bank created the Inspection Panel. At the time, it was hailed as an unprecedented effort to increase the Bank's accountability. Prior to the establishment of the Panel, the Bank had engaged in a number of projects that devastated local populations and caused significant environmental damage. After unrelenting pressure from environmental and human rights non-governmental organizations ("NGOs"), the World Bank established the Inspection Panel with hopes of bringing transparency to the Bank's project lending. Generally, the Panel is charged with investigating complaints filed by parties in borrower countries who believe that the Bank is violating its policies or procedures in the design, preparation, or implementation of a Bank-funded project. Despite its novelty when it was established in 1993, there are many critiques of the Panel. In general, critics question whether the Panel truly increases the accountability of the World Bank on the whole. Critics often point out that it has a limited substantive mandate and no ability to grant relief. Furthermore, the mechanism fails to give affected people a true voice in the outcome of an investigation. After the Panel receives the claim, the Bank rarely considers the affected communities' desires for resolution. In essence, the Panel is compliance-oriented, and problem-solving is not a principal focus. This paper proposes an alternative to the current Inspection Panel process that would offer real and meaningful accountability. Our proposal envisions a two-stage process that first would require claimant communities to file a Request for Claim Resolution with a newly created Office of Claims Resolution ("OCR") at the World Bank. The Director of the OCR would appoint an independent Intermediator who would attempt to solve the problem created by the Bank's alleged noncompliance with its own policies and procedures. We expect that most claims would be resolved at the administrative level. If, however, the Intermediator failed to resolve the claim or if the Bank agreed to corrective measures but failed to abide by them, claimant communities would have the option to institute arbitration proceedings against the Bank. The proceedings would be conducted based on a modified version of the Optional Rules for Arbitration between International Organizations and Private Parties produced by the Permanent Court of Arbitration. The tribunal's decision would be public, final, and binding upon the parties. Its award could set forth corrective measures that the Bank would be required to take to bring it into compliance with its policies and procedures. The tribunal could also award damages to the claimant community.

Book The World Bank s Inspection Panel

Download or read book The World Bank s Inspection Panel written by Yvonne Wong and published by . This book was released on 2014 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This chapter examines the general functioning of the World Bank Inspection Panel during its first two decades of operation (1994-2014) to assess whether it really is a vehicle through which individuals can hold the World Bank accountable. In making this assessment, the chapter considers (a) the history of the panel's creation; (b) the novelty of the panel as a mechanism for implementing the accountability of an international organization; (c) the legal framework of the panel; (d) the accessibility of the panel to the people it seeks to help; (e) the transparency, independence, and public accountability of the panel; and (f) the direct and indirect outcomes of the panel mechanism. The chapter suggests that, while not providing affected persons a legal avenue for redress, the Inspection Panel, if used strategically as part of larger advocacy strategies, particularly by increasing media coverage on problematic projects, can nevertheless serve as a useful tool in helping redress wrongs committed as a result of the Bank's failure to comply with its own policies. More generally, the panel can also push for a cultural change toward greater consideration of the unintended consequences of development projects.

Book Opening the Black Box

Download or read book Opening the Black Box written by Helene Grandvoinnet and published by World Bank Publications. This book was released on 2015-04-17 with total page 351 pages. Available in PDF, EPUB and Kindle. Book excerpt: Opening the Black Box: Contextual Drivers of Social Accountability fills an important knowledge gap by providing guidance on how to assess contextual drivers of social accountability effectiveness. This publication aims to more strategically support citizen engagement at the country level and for a specific issue or problem. The report proposes a novel framing of social accountability as the interplay of constitutive elements: citizen action and state action, supported by three enabling levers: civic mobilization, interface and information. For each of these constitutive elements, the report identifies 'drivers' of contextual effectiveness which take into account a broad range of contextual factors (e.g., social, political and intervention-based, including information and communication technologies). Opening the Black Box offers detailed guidance on how to assess each driver. It also applies the framework at two levels. At the country level, the report looks at 'archetypes' of challenging country contexts, such as regimes with no formal space or full support for citizen-state engagement and fragile and conflict-affected situations. The report also illustrates the use of the framework to analyze specific social accountability interventions through four case studies: Sierra Leone, Pakistan, Yemen, and the Kyrgyz Republic.

Book Legitimation and Delegitimation in Global Governance

Download or read book Legitimation and Delegitimation in Global Governance written by Magdalena Bexell and published by Oxford University Press. This book was released on 2022-11-07 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is an open access title available under the terms of a CC BY-NC-ND 4.0 International licence. It is free to read at Oxford Scholarship Online and offered as a free PDF download from OUP and selected open access locations. The legitimacy of global governance institutions is both contested and defended in contemporary global politics. Legitimation and Delegitimation in Global Governance explores processes of legitimation and delegitimation of such institutions. How, why, and with what impact on audiences, are global governance institutions legitimated and delegitimated? The book develops a comprehensive theoretical framework for studying processes of (de)legitimation in governance beyond the state. It provides broad comparative analyses to uncover previously unexplored patterns of (de)legitimation processes. A diverse set of global and regional governmental and nongovernmental institutions in different policy fields are included. Variation across these institutions is explained with reference to institutional set-up, policy field characteristics, and broader social structures, as well as to the qualities of agents of (de)legitimation. The approach builds on a mixed-methods research design that uses quantitative and qualitative new empirical data. Three main interlinked elements of processes of legitimation and delegitimation are at the center of the analysis: the varied practices employed by different agents that may boost or challenge the legitimacy of institutions; the normative justifications that these agents draw on when engaging in legitimation and delegitimation practices; and the different audiences that may be impacted by legitimation and delegitimation. This results in a dynamic interplay between legitimation and delegitimation in contestation over the legitimacy of GGIs.

Book Social Rights Jurisprudence

Download or read book Social Rights Jurisprudence written by Malcolm Langford and published by Cambridge University Press. This book was released on 2009-01-19 with total page 705 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the space of two decades, social rights have emerged from the shadows and margins of human rights jurisprudence. The authors in this book provide a critical analysis of almost two thousand judgments and decisions from twenty-nine national and international jurisdictions. The breadth of the decisions is vast, from the resettlement of evictees to the regulation of private medical plans to the development of state programs to address poverty and illiteracy. The jurisprudence not only implicates our understanding of economic, social, and cultural rights, but also challenges the philosophical debates that question whether these rights can and should be justiciable.

Book Corporate Accountability

Available in PDF, EPUB and Kindle. Book excerpt: Whilst many of us would agree that human rights are more important than corporate profits, the reality is often different; such realities as child labour and environmental destruction caused by corporate activities make this patently clear. Recognising that balancing human rights and business interests can be problematic, Corporate Accountability considers the limits of existing complaint mechanisms and examines non-judicial alternatives for conflict resolution.

Book Civil Society and Regional Governance

Download or read book Civil Society and Regional Governance written by Anders Uhlin and published by Lexington Books. This book was released on 2016-09-12 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: Through detailed comparative case studies of civil society engagement with two major regional international organizations in Southeast Asia this book demonstrates the potentials and limitations of civil society actors as democratizing agents in governance beyond the nation-state. Drawing on previous research on civil society, social movements, transnational activism, and democratization, Uhlin develops an analytical framework focusing on a) how national and international political opportunities shape—and are shaped by—civil society advocacy; b) how civil society activists frequently combine inside and outside strategies when targeting international organizations; and c) how civil society advocacy can have a liberalizing impact on the targeted international organizations. Drawing on rich empirical data, including more than 100 qualitative interviews with civil society activists and representatives of the Asian Development Bank (ADB) and the Association of Southeast Asian Nations (ASEAN), the study demonstrates how civil society actors have contributed to pushing ADB—and to a much lesser extent ASEAN—in a political liberal direction, improving transparency, strengthening accountability, and introducing mechanisms protecting people from the abuse of power. With its innovative analytical framework, broad scope covering civil society activism across Southeast Asia, and in-depth analysis of civil society attempts to influence ADB and ASEAN the book makes important contributions to research on civil society activism in Southeast Asia as well as the more general field of civil society and governance beyond the nation-state.

For researchers in nonprofit and civil society studies, political science, economics, management and social enterprise, this is the most systematic appraisal of a rapidly growing field.
