Book excerpt: The Disability Discrimination Bill (Cm. 6058-I/II/III, ISBN 010160582X published in December 2003) extends the Disability Discrimination Act 1995 to cover the functions of public bodies, imposing a positive duty to eliminate discrimination and harassment and to promote equality of opportunity for disabled people. This consultation paper seeks views on proposals for the guidance the Disability Rights Commission should issue to support the implementation of these changes, and on the possible use of regulatory powers. Issues discussed include: changing working cultures, the specific duties and range of public bodies covered, guidance to be issued to smaller bodies, content of guidance relating to procurement, how public authorities can promote equality in practice, gathering evidence and reporting progress, implementation of new duties, and costs and benefits of the proposals. EU legislation requires Member States to introduce laws prohibiting racial discrimination in many aspects of everyday life, including employment, education, healthcare, and housing. Alongside legislation requiring action at national level, the EU institutions have also made periodic commitments to 'mainstream' racial equality: taking anti-racism objectives into account within all areas of EU law and policy. This book analyses the extent to which the objectives of combating racism and promoting ethnic equality have been effectively mainstreamed throughout a wide range of EU policy fields. It begins by considering what combating racism means in the contemporary context of the enlarged EU. Bell explores what mainstreaming ethnic equality objectives entails, and whether the priorities and instruments differ from those adopted in the earlier mainstreaming of gender equality, or those used on other discrimination grounds. The second part of the book examines the extent to which EU law and policy objectives have, in practice, been integrated, exploring the effects in the key areas of employment, social inclusion (including education, health and housing), immigration, and criminal law.

(1) Each facility or part of a facility constructed by, on behalf of, or for the use of a public entity shall be designed and constructed in such manner that the facility or part of the facility is readily accessible to and usable by individuals with disabilities, if the construction was commenced after January 26, 1992. (2) Exception for structural impracticability. (i) Full compliance with the requirements of this section is not required where a public entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.

A substantial body of equality legislation has been introduced over the last four decades, but the legislation has become complex and hard to understand. The Equality Bill will declutter and strengthen the law. The Bill will introduce a new Equality Duty on the public sector, replacing the three existing duties on race, disability and gender and extending to gender reassignment, age, sexual orientation and religion or belief. The Bill will contain powers to outlaw unjustifiable age discrimination, but there will be further consultation on the design of the legislation before the new legal protections are introduced. Transparency is essential to tackling discrimination, and public bodies will have to comply with the Equality Duty over gender pay, ethnic minority employment and disability employment. The Government will work with business to improve transparency in the private sector. The Bill will extend the scope of positive action so that employers can take account, when selecting between two equally qualified candidates, under-representation of disadvantaged groups. Permission to use women-only shortlists for parliamentary candidates will be extended to 2030. Non-legislative measures to increase the number of ethnic minority elected representatives in Parliament and local councils will be pursued. Finally the Bill will aim to strengthen enforcement. Tribunals will be allowed to make wider recommendations in discrimination cases, which will go beyond benefitting the individual taking the case so that there are benefits for the rest of the workforce of the employer found to have discriminated. A more comprehensive paper on the content of the Bill will be published shortly.

Book excerpt: The Committee welcomes the Government's intentions to simplify and streamline legislation on discrimination into one single Equality Bill. But it believes that disability discrimination requires a difference in approach and should be predicated on the idea that we need to treat people differently to accord disabled people equal opportunities. The challenge is to bring disability discrimination law within that broad family of equality law whilst recognising those key differences. To meet this objective, the Government should re-establish the version of disability-related discrimination that existed before the recent Lewisham v Malcolm judgment and which was well understood by employers and employees alike. Preserving strong disability rights needs to go hand in hand with an adequate defence for those with duties under the legislation. Harmonising the different provisions that currently permit employers, service providers, landlords and others to justify disability discrimination in certain circumstances will ensure a balance between their responsibilities and the rights of the disabled person. The Committee also calls for removal of one of the greatest obstacles to improving employment opportunities for older people: the continued existence of the statutory default retirement age in the Employment Equality (Age) Regulations 2006. The overall employment rate of disabled people has increased since 1995, but the rate for people with mental illness, phobias or panic has remained substantially lower (at just over 10 per cent) than that for those with most other types of impairment. Too many employers and disabled people are unaware of what support is available for them through the Access to Work scheme. DWP research identified recruitment as the most common source of discrimination against disabled people but few cases reach court. The public sector has an important role to play in promoting equality but needs to focus on outcomes not process.
