Book excerpt: En este trabajo de investigación se analizan minuciosamente el artículo 319 del Código penal, dedicado a los delitos sobre la ordenación del territorio y el urbanismo, integrado en el Capitulo I del Título XVI. Se examinan por separados los cuatros apartados del artículo 319 del CP. En el primero se estudia la forma agravada, y en el segundo de los apartados, la forma básica sobre los atentados que se cometan al bien jurídico protegido ordenación racional del territorio. Se hace un análisis a los sujetos activos que son los mismos para los dos apartados (promotores, constructores y técnicos directores); también se tratan las conductas típicas sobre las obras de urbanización, construcción y edificación; así como las consecuencias jurídicas que son de tres tipos, prisión, multa e inhabilitación especial para la profesión u oficio. En el apartado tercero del artículo 319 se trata la orden de demolición de lo construido o edificado contra la ordenación del territorio, que tras la reforma del Código Penal mediante la LO 5/2010, se ha ampliado el alcance de la demolición, a la orden también de reposición a su estado originario de la realidad física alterada. Como novedad también de la reforma del nuestro texto punitivo por LO 5/2010, resulta la necesidad de acudir en estos tipos de delitos a la institución del comiso que había sido propugnado por una parte de la doctrina penal para su adaptación a la normativa europea, concretamente a la Decisión Marco 2005/212/JAI. También con esta reforma se introduce por primera vez en el sistema penal de nuestro país, la responsabilidad penal de las personas jurídicas en detrimento del principio societas delinquere non potest, que hacía imposible la imputación de los delitos a las sociedades mercantiles investidas con personalidad jurídica.
