Yet, corporations are not traditional objects of criminal law. Justified by notions of personal moral guilt, criminal norms have been judged inapplicable to fictional persons, who ‘think’ and ‘act’ through human beings. The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders. It considers whether municipal CCL laws are converging around the notion of ‘corporate culture’, and, in any case, the implications of CCL for those charged with keeping corporations, and other legal entities, out of trouble.

Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

La Ley 1273 del g de enero de 2009 adicionó el Código Penal con el Título VII Bis, denominado "De la protección de la información y de los datos", cuyo Capítulo segundo trata "De los atentados informáticos y otras infracciones" y tipifica los delitos de hurto por medios informáticos y semejantes (art. 2691 CP) y transferencia no consentida de activos (art. 269J c.P.). En esta edición me ocupo del análisis de estas figuras delictivas, porque si bien es cierto que los delitos descritos en dicho Capítulo segundo del Título VII Bis tutelan la información y los datos, también lo es que protegen además el patrimonio económico, dado que así lo dispone de manera expresa el artículo 2691 al remitir al tipo descrito en el artículo 239 del Código Penal, que contiene el tipo básico del delito de hurto. De otra parte, el delito de transferencia no consentida de activos tiene como objeto material derechos de crédito constitutivos del patrimonio económico.

Many Surgeon General's reports have considered research findings on mechanisms in assessing the biological plausibility of associations observed in epidemiologic studies. Mechanisms of disease are important because they may provide plausibility, which is one of the guideline criteria for assessing evidence on causation. This report specifically reviews the evidence on the potential mechanisms by which smoking causes diseases and considers whether a mechanism is likely to be operative in the production of human disease by tobacco smoke. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.
