Available in PDF, EPUB and Kindle. Book excerpt: Foundations of Property Law: Things as Objects of Property Rights is an abridged translation of the first volume of Christian von Bar's Gemeineuropäisches Sachenrecht -a milestone in European private law theory, and in comparative property law more broadly. Radical in content and scope, the English version examines the dynamics of interaction between the objects, contents, and holders of property. The conceptual framework of 'property law' is presented as a domain of erga omnes monopoly rights that govern the relationship between persons and objects of value. Within that framework, a reciprocal relationship is illustrated between "property rights" and their objects; property rights play a role in constituting the very objects ("things") in which they are held. With comprehensive comparative analysis, insights are gleaned from all the jurisdictions of the European Union and the United Kingdom, presenting a critical evaluation of property law systems in both Common and Civil Law traditions. This book joins all the national legal systems in a single inquiry, treating their traditions and arguments with the respect they deserve and taking advantage of the knowledge embodied in the diversity of European private law. A scholastic work, offering deep and unique insights into the European property law systems, Foundations of Property Law will quickly become a go-to resource for anyone interested in European private law and comparative property law.

Book Rivista di Estetica 85

Download or read book Rivista di Estetica 85 written by AA.VV. and published by Rosenberg & Sellier. This book was released on 2024-07-05 with total page 220 pages. Available in PDF, EPUB and Kindle. Book excerpt: This issue of the 'philosophy of the city' includes articles by scholars on a range of human sciences, from media theory to aesthetics and architectural theory. Philosophy, social ontology, cultural anthropology, aesthetics, digital hermeneutics, media theory, cognitive science: these are just some of the disciplines that contribute to the philosophy of the city. This variety of approaches doesn't necessarily result in a chaotic mix. Many of the included forms of discourse belong to the same episteme, which means there are many connections and overlaps. This is true both in the literatures of reference and in the ways of answering the question of what 'the city' is. Secondly, the texts don't focus on the city itself, but on those who live in, design, imagine and think about it. Thirdly, because these texts create a place where different ideas can live together. This is like a city, where ideas change, are built on and then rebuilt. This is what Wittgenstein wrote about in his Philosophical Investigations.

Book Digitization Copyright and the Law

Download or read book Digitization Copyright and the Law written by Ettore M. Lombardi and published by Taylor & Francis. This book was released on 2024-09-13 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses copyleft and its impact on the traditional way to conceive of property. It is specifically focused on the European and international juridical framework. Analysing the impact of digitalization on copyright and the potential effect of copyleft in the European market and within a European and international juridical framework, this book explores the complex evolutionary framework which charts the reduction of physical property and the progressive expansion of intangible assets. Although digitalization enables more accessibility than ever before, this impacts traditional intellectual property frameworks. Evaluating common traits of ownership structure, the book considers the challenges that intangible property, open source and creative commons present to the current legal system. Examining the impact of copyleft on copyright and the law of ownership, the book considers the rights of authors and creators, legal limits and complications arising from these new forms of ownership of intangible assets. The book is grounded in the European potential regulatory framework of copyleft through movements like open-source software. The book will be of interest to students, academics and practitioners with an interest in contract law, property law and intellectual property law.

Book Protection of Immovables in European Legal Systems

Download or read book Protection of Immovables in European Legal Systems written by Sonia Martin Santisteban and published by Cambridge University Press. This book was released on 2015-09-11 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: How should a landowner respond when a squatter occupies their land? This book discusses the issues focussing on vindicatio, possessory remedies and trespass, but also explores administrative procedures for their removal. In many cases, these actions derive from Roman laws, which are expertly explored in an introductory chapter. Also included is a chapter exploring human rights interventions in such actions. Twelve case studies offer an extensive and comparative analysis across sixteen European jurisdictions. The basic defendants covered are squatters taking over a home, environmental protesters, licensees and former tenants. The case studies include, amongst others, self-help; restitution; competing claims to ownership (and the relevance of registration systems to claims to ownership); adverse possession; neighbours; nuisance and encroachment.

Book Essays on Private Law

    Book Details:
  • Author : Ian F.G. Baxter
  • Publisher : University of Toronto Press
  • Release : 1966-12-15
  • ISBN : 1442633360
  • Pages : 363 pages

Download or read book Essays on Private Law written by Ian F.G. Baxter and published by University of Toronto Press. This book was released on 1966-12-15 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contains a series of essays on conflict laws, including jurisdiction of the courts, choice of law, renvoi, property, recognition of family status, and recognition of foreign corporations. It is not a text-book, but an analysis and criticism of existing principles with recommendations for reform and for a different approach to the subject. In general, an approach is advocated that will be simpler and less abstract and doctrinaire than at present, and better integrated with the ordinary laws of the forum. The recommendations made could be thought of as principles on which to build a reform of conflict of laws or a model code. The first two chapters deal with jurisdiction and choice of law, two distinct topics, with different considerations of policy, which have not always been kept distinct by judges and text writers. The third chapter considers certain questions of legal interpretation, mainly in the construction of money obligations expressed in a foreign currency. This shows a working out of the problems of contract analysis and interpretation which are dealt with more generally in other chapters. Another chapter discusses property law, a branch of the law which has been influenced, historically, by the doctrine of situs, and the recognition of status in family law and in corporation law. The concluding chapter draws together the main results of the preceding discussion and states from basic principles, one of which is that there is a need “for greater unity between the conflict rules and the general law,” and for “allowing, where appropriate, the influence of legal systems other than that of the forum.” Professor Baxter’s discussion clearly shows that the complexity of current legal theory can lead to unjust rulings in the courts, and his case for greater simplification is argued compellingly.

Book The Transformation of a Religious Landscape

Download or read book The Transformation of a Religious Landscape written by Valerie Ramseyer and published by Cornell University Press. This book was released on 2015-10-26 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Transformation of a Religious Landscape paints a detailed picture of the sheer variety of early medieval Christian practice and organization, as well as the diverse modes in which church reform manifested itself in the eleventh and twelfth centuries. From the rich archives of the abbey of the Holy Trinity of Cava, Valerie Ramseyer reconstructed the complex religious history of southern Italy. No single religious or political figure claimed authority in the region before the eleventh century, and pastoral care was provided by a wide variety of small religious houses. The line between the secular and the regular clergy was not well pronounced, nor was the boundary between the clergy and the laity or between eastern and western religious practices. In the second half of the eleventh century, however, the archbishop of Salerno and the powerful abbey of Cava acted to transform the situation. Centralized and hierarchical ecclesiastical structures took shape, and an effort was made to standardize religious practices along the lines espoused by reform popes such as Leo IX and Gregory VII. Yet prelates in southern Italy did not accept all aspects of the reform program emanating from centers such as Rome and Cluny, and the region's religious life continued to differ in many respects from that in Francia: priests continued to marry and have children, laypeople to found and administer churches, and Greek clerics and religious practices to coexist with those sanctioned by Rome.

Book Propertizing European Copyright

Download or read book Propertizing European Copyright written by Caterina Sganga and published by Edward Elgar Publishing. This book was released on 2018-02-23 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: With an acceleration in the last decades, the language of property, piracy and theft has become mainstream in copyright matters. Scholars have argued that this latent propertization has progressively led to the undue expansion of copyright and an enclosure of knowledge, causing clashes with users’ fundamental rights and EU social and cultural policies. Challenging the validity of such critiques, Propertizing European Copyright demonstrates that these distortive effects are only the result of mishandled property rhetoric and that a commitment to copyright propertization could enable a more internally consistent and balanced development of EU copyright law.
