Civil and commercial space actors that engage in international endeavors must comply with space technology export controls. In the general discourse, members of the civil and commercial space community have an understanding of their domestic export control regime. However, a careful reading of the literature on space technology export controls reveals that certain questions relevant to international engagements have not been identified or answered. What is the legal-political origin of space technology export controls? How do they relate to the current international legal structure? What steps can be taken to evolve our current unilateral paradigm of space technology within the context of peaceful exploration and use of outer space? In this book, these and other relevant questions on space technology export controls are identified and assessed through an insightful case-study of the U.S. commercial communication export control regime. The findings of this case-study are used in an international legal-political analysis of international space law, public international law, and international cooperation. Breaking new ground in international legal theory, a self-justified security dilemma that is manifest in international law is identified and explained as the origin for the current paradigm of space technology export controls.

In today’s globalized world, EU law and the ECJ’s decisions have been calling for exceptions and defining new connecting elements that make the traditional approach of EU law, based on the territoriality principle, less straightforward. This is the case with e.g. the effects doctrine in the context of EU competition law, as was fully recognized after the ECJ’s Intel case. Moreover, recently approved rules concerning the EU’s internal market, EU environmental law and EU data protection law have made it more difficult to define the application of EU law in terms of a pure link to the territoriality principle. The book examines these and other problems from the perspectives of various branches of EU economic law. With regard to EU competition law it presents, among others, studies on the evolution of the effects doctrine in the US and the EU; extraterritoriality of competition law; global cartels; merger control; state aid and cooperation between NCAs. In particular, this book analyzes and evaluates the effectiveness of export controls in delaying the acquisition of militarily sensitive high technology by the Soviet Union and its allied states. Furthermore, the question of whether or not U.S. economic competitiveness in various high-technology sectors has been unduly undermined by export controls is also evaluated. Numerous official government studies and reports, supplemented by a host of interviews with government officials, businesspeople, and analysts in the United States and Europe are utilized in drawing conclusions and posting policy recommendations. The consequences for export control policy of the revolutionary political upheavals in Eastern Europe and the former U.S.S.R. are also addressed. The study concludes that the strategic/security goal of utilizing controls to hinder and delay the acquisition of militarily significant high technology by the former Soviet Union and its allied states was generally effective. More controversially McDaniel argues that export controls per se have not been a significant determinant of lagging U.S. competitiveness in high technology. However, this conclusion is qualified by the observation that while overall trends in U.S. high-technology exports to important trading partners do not suggest that controls by themselves have unduly hurt U.S. exporters, individual sectors and small firms may be disadvantaged. Finally, the study cautions that U.S. policy must adapt or risk becoming outmoded and increasingly ineffective. This book will be of interest to scholars and students of international relations, international political economy, and international business.
