Major acquisitions in the Department of Defense Defense's (DOD) ongoing force transformation including manned and unmanned aircraft systems, networkcentric communications systems, and air and ground weapons rely on maintaining technological superiority. Failure to identify and protect critical technologies makes U.S. military assets vulnerable to cloning, neutralization, or other action that degrades current and anticipated capabilities. To help minimize these risks, DOD Dod's Militarily Critical Technologies Program developed and periodically updates two lists of technologies the Militarily Critical Technologies List (MCTL) and the Developing Science and Technologies List (DSTL) each consisting of 20 sections. These lists are primarily intended to inform U.S. export control decisions, but can also help inform counterintelligence activities, research plans, and technology protection programs. As such, the MCTL and DSTL are considered fundamental to identifying technologies critical to national security that can help inform decisions to ensure U.S. technological advantage for the warfighter. Redefined national security threats, rapid technological advances, and increasing efforts by adversaries to gain access to U.S. military weapon system technology heighten the need to identify and protect militarily critical technologies. Given the importance of the MCTL and DSTL, you asked us to (1) assess the Militarily Critical Technologies Program's process for updating the MCTL and DSTL and (2) determine how the lists are used to inform export control and DOD policy decisions.

In 2006, GAO reported that the MCTL was out of date and not meeting users' requirements, and subsequently included the list as a key component of GAO's high risk area on protecting critical technologies. This report updates GAO's 2006 work and reviews the extent to which 1) DOD has addressed weaknesses in updating and maintaining the MCTL, and 2) agencies use the MCTL as a resource in identifying critical technologies. For instance, suppose an engineer develops an improved processing method for high temperature ceramics that enables near net shape manufacture of complex parts. A paper is prepared which details the production method and various materials used and is presented at a Materials Research Society (MRS) conference. Forty people are in attendance during this particular session and the paper is published in the proceedings of the conference Does this engineer realize that a law may have been broken? The Department of Defense is congressionally mandated to maintain a list detailing those critical technologies that help maintain the superiority of U.S. armed forces. Technologies on this list are considered for integration into the Department of Commerce's export control lists, such that proliferation may be limited. In the example above, the engineer, in a public forum, presented a processing method that may produce components with performance characteristics which provide a competitive military edge over our adversaries.

A Mission-Technology Correlation Task Force (MTCTF) was established to analyze technologies and mission areas with regard to their likely impact on the future military balance. The analysis described in this report is limited to three mission areas: land-based ICBM strike, tactical air warfare (close air support and battlefield interdiction), and theater nuclear warfare (air delivered). In each of the three areas the technologies are prioritized on the basis of their importance to the U.S. and their potential contribution to Soviet capability. It is concluded that the ranking of technologies resulting from the analysis provides a valuable input into decisions on export restrictions. If this approach is to be extended to other mission areas or lists of technologies, the lessons from this analysis should be applied.

Working with an informal structure, TWG members who come from government, industry, and academia strive to produce precise and objective analyses across the technology areas. Part II of the MCTL is titled Developing Critical Technologies. Developing Critical Technologies lists technologies that will produce increasingly superior performance of military systems or maintain a superior capability more affordably. It focuses on worldwide technologies that will become available in the future for incorporation into U.S. weapons systems.

This activity can also be used to transfer military equipment, knowledge, and technology to hostile governments and transnational terrorist and criminal organizations seeking to attack and destroy their enemies. The U.S. and other countries have used economic sanctions such as export controls to try to restrict and eliminate the transfer of weapons and financial assets to these governments and organizations. This work examines how the U.S. has attempted to restrict the export of national security sensitive equipment, finance, knowledge, and technology since World War II with varying degrees of success and failure. It also examines how multiple U.S. Government agencies, nongovernmental organizations, and international government organizations seek to influence U.S. international trade, foreign, and security policies while concluding that some export controls are essential for promoting and defending U.S. national security interests.
