Given the significant sums spent to acquire goods and services, the Federal Acquisition Regulation (FAR) was amended twice starting in December 2007 to first mandate and later amplify contractor ethics program rules. Before FAR changes were finalized in December 2008, Congress required GAO to report in 2009 on the ethics programs of major defense contractors. This report (1) describes the extent that contractors had ethics programs before the finalization of the FAR rules that included practices consistent with standards now required by the FAR and (2) assesses the impact the new FAR rules have on Department of Defense (DOD) oversight of contractor ethics programs. To do this work, in September 2008 GAO surveyed all 57 contractors-those receiving more than $500 million in 2006 DOD contract awards-and interviewed DOD contractor oversight agency officials on the impact of the new FAR rules on oversight.

GAO recommends four actions aimed at improving oversight of ethics programs during contract administration and DOD hotline poster requirements for contractors to ensure that whistleblower protections are communicated. DOD concurs with GAO's recommendations.

Available in PDF, EPUB and Kindle. Book excerpt: In fiscal year 2004, the Department of Defense (DOD) spent more than $200 billion to purchase goods and services. To help ensure defense contracts are awarded fairly and current and former employees do not use their knowledge of DOD acquisition activities to gain financial or other benefits, DOD personnel are required to conduct themselves in a manner that meets federal ethics rules and standards. Regulations require DOD to implement an ethics program and provide that contractors meet certain ethics standards. For this report, GAO assessed (1) DOD's efforts to train and counsel its workforce to raise awareness of ethics rules and standards as well as DOD measures of the effectiveness of these efforts and (2) DOD's knowledge of defense contractors' programs to promote ethical standards of conduct.

Walker and published by DIANE Publishing. This book was released on 2008-07 with total page 42 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fed. gov¿t., incl. the DoD, is relying on contractors to carry out many of its missions. Governmentwide spending on contractor services has more than doubled in the last 10 years. DoD has used contractors extensively to support troops deployed abroad; there are about 196,000 contractors in Iraq and Afghanistan. While contractors can play an important role in helping agencies accomplish their missions, there have been problems regarding the appropriate role and mgmt. of contractors, particularly at DoD. This testimony highlights the challenges DoD has had in managing its increased reliance on contractors who support deployed troops and who provide logistics support for weapons. Includes recommendations.

Book excerpt: The DoD relies extensively on contractors to support deployed forces for services that range from food and housing services to intelligence analysis. Since 1997, there have been reports on DoD¿s shortcomings in managing and overseeing its use of contractor support. Part of the difficulty attributed to these shortcomings is that no one person or entity made the decision to send 129,000 contractors to Iraq. Rather, numerous DoD activities were involved, thus adding to the complexity of the problems. This testimony focuses on the problems that DoD has faced, & future challenges, in managing & overseeing its contractor support to deployed forces. Charts & tables.

Book Ethical Dilemmas in the Global Defense Industry

Download or read book Ethical Dilemmas in the Global Defense Industry written by Daniel Schoeni and published by Oxford University Press. This book was released on 2023-03-10 with total page 537 pages. Available in PDF, EPUB and Kindle. Book excerpt: The defense industry develops, produces, and sells weapons that cause great harm. It operates at the intersection of the public and private sectors, with increased reliance on technology companies. Although such firms exist primarily to serve their host states, they routinely interact with foreign legal systems and diverse cultures. This context creates unique ethical challenges. That being the case, is the defense industry ethically defensible? How should it be regulated? How should it respond to worrisome technological developments such as autonomous weapons systems? How should business be conducted in countries where bribery is the norm? To what extent can this industry's intrinsic ethical problems be overcome? This book addresses such questions, bringing together the diverse perspectives of scholars and practitioners from academia, government service, the military, and the private sector. It aims to inform a discussion about the moral and legal challenges facing the global defense industry and to introduce solutions that are innovative, effective, and practical.

This book was released on 2017-08-11 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: To meet urgent needs, DOD can issue undefinitized contract actions (UCA), which authorize contractors to begin work before reaching a final agreement on contract terms. Such actions are considered to be a risky contract vehicle for the government because contractors lack incentives to control costs during this period. Defense regulations provide that the government determination of contractors allowable profit or fee should reflect any reduced cost risk.Pursuant to the 2008 National Defense Authorization Act, GAO assessed whether DOD actions taken as required by the act have (1) improved departmental insight and oversight of UCA use and (2) resulted in local commands meeting DODs standards for documenting the basis for negotiating the contractor profit or fee, definitization timelines, and obligation amounts. GAO reviewed relevant DOD regulations and policies, and contract files for 83 randomly-selected UCAs totaling $6.1 billion at eight local commands. The findings from this contract file review can not be generalized across DOD.
