Book excerpt: While legal scholars, psychologists, and political scientists commonly voice their skepticism over the influence oral arguments have on the Court’s voting pattern, this book offers a contrarian position focused on close scrutiny of the justices’ communication within oral arguments. Malphurs examines the rhetoric, discourse, and subsequent decision-making within the oral arguments for significant Supreme Court cases, visiting their potential power and danger and revealing the rich dynamic nature of the justices’ interactions among themselves and the advocates. In addition to offering advancements in scholars’ understanding of oral arguments, this study introduces Sensemaking as an alternative to rational decision-making in Supreme Court arguments, suggesting a new model of judicial decision-making to account for the communication within oral arguments that underscores a glaring irony surrounding the bulk of related research—the willingness of scholars to criticize oral arguments but their unwillingness to study this communication. With the growing accessibility of the Court’s oral arguments and the inevitable introduction of television cameras in the courtroom, this book offers new theoretical and methodological perspectives at a time when scholars across the fields of communication, law, psychology, and political science will direct even greater attention and scrutiny toward the Supreme Court.

'Citizenship' has, accordingly, become one of the dazzling key words whenever the democratic deficit of modern societies is moaned about. Asking for citizenship to be conceived of as a communicative achievement, the present book shows that sociolinguistics and pragmatics can essentially contribute to this interdisciplinary up-to-date issue of research: the volume offers a theoretically innovative concept of communicated citizenship and it presents a set of methodological approaches suited to deal with this concept at an empirical level (including contributions from Conversation Analysis, Critical Discourse Analysis, Social Positioning Theory, Speech Act Theory and Ethnography). Furthermore, concrete data and empirical analyses are provided which take up the case of decision-making processes around the application of modern 'green' biotechnology ('GMO field trials'). The volume thus illustrates the kind of findings and results that can be expected from this new and promising approach towards citizenship talk.

Over a three-day period twenty-two analysts and practitioners of public participation from the United States and Europe came together to address one of the most pressing issues in contemporary environmental politics: How can environmental policies be designed in a way that achieves both effective protection of nature and an adequate representation of public values? In other words, how can we make the environmental decision process competent and fair? All the invited scholars from academia, international research institutes, and governmental agencies agreed on one fundamental principle: For environmental policies to be effective and legitimate, we need to involve the people who are or will be affected by the outcomes of these policies. There is no technocratic solution to this problem. Without public involvement, environmental policies are doomed to fail. The workshop was preceded by a joint effort by the three editors to develop a framework for evaluating different models of public participation in the environmental policy arena. During a preliminary review of the literature we made four major observations. These came to serve as the primary motivation for this book. First, the last decade has witnessed only a fair amount of interest within the sociological or political science communities in issues of public participation.
