To begin my thesis, I will first talk about the background and history of Prostitution. How long has it existed, where does it originate, and how has it changed over the centuries. There will be a list of reasons accounting for, why Prostitution is such an old profession. A main aspect is poverty, which is a development issue. Further, I will explain why the German Government moved to legalize Prostitution in 2002 and the impact of this decision. To improve recognition of prostitutes and make their job safer, the Prostitution Protection Law came into effect in 2017. It is important to understand the different opinions of feminists on this topic, because most prostitutes are women. It all comes down to the way people view prostitution: as a violation of human dignity or as an autonomous decision to risky activity or as a profession like any other. As my last topic, I will explain the Swedish Model and how it developed. Sweden has a completely different view on how to deal with prostitution than Germany. Both countries decided to pass laws for more gender equality. However, the impacts of the laws are unique. That is why there will be a debate in the end as to why social work is necessary in dealing with prostitution. “The dignity of men is sacrosanct” - this is the first Article of the Constitutional Law in Germany. If every person has the same value and worth, everybody must be treated the same way. How does this include people who are forced into prostitution? They aren’t being treated like any other person - instead, some people think that since they are paying for sexual services, they can treat people on the sex industry however they want.

They also point out that prostitutes should be left to choose they way they earn their income as that is their right, therefore the society should not interfere with their rights. On the other hand, opponents of prostitution assert that many of these prostitutes are in the business against their will and legalizing it would only increase cases of forced prostitution. They also brought up the issue of sex trafficking and child prostitution; accordingly they point out that prostitution is dehumanizing, risky and dehumanizing. They restate that the abuses and possible dangers for legalizing prostitution outweigh the possible benefits of legalizing prostitution. And the debate goes on: Should prostitution be legalized? This paper enters into this debate by arguing that prostitution should not be legalized, the following points supports this position.

Debates about how best to understand and regulate prostitution are bound up with difficult moral, legal, and political questions. Indeed, it can be approached from numerous angles--is buying and selling sex fundamentally wrong? How can it possibly be regulated? How can sex workers be protected, if they are allowed to work at all? In this concise, for-and-against volume, ethicists Lori Watson and Jessica Flanigan engage with each other on the nature and consequences of sex work, revealing new and profound ways in which to understand it. The volume opens with a joint introduction, before Lori Watson first argues for a sex equality approach to prostitution in which buyers are criminalized and sellers are decriminalized, also known as the Nordic model. Watson defends the Nordic Model on the grounds that prostitution is an exploitative and unequal practice that only entrenches existing patterns of gendered injustice. Full decriminalization of prostitution only stymies existing occupational health and safety standards and securing worker autonomy and equality. Further, to Watson, drawing a distinction between sex trafficking and prostitution is irrelevant for public policy; what underpins them is demand, which fuels the inequalities of both. That is what needs to be addressed. In a rebuttal, Jessica Flanigan contends that sex work should be fully decriminalized because restrictions on the sale and purchase of sex violate the rights of sex workers and their clients. She argues that decriminalization is preferable to policies that could expose sex workers and their clients to criminal penalties, and leave them at the mercy of public officials. Putting these two views on sex work into conversation with one another, and opening up space for readers to weigh both approaches, the book provides a thorough, accessible exploration of the issues surrounding sex work, written with both sympathy and philosophical rigor.

In addition, there is a partial ban against buying sex in Finland. This is a different approach from that of several other European countries, where we have seen a decriminalisation of third-party involvement in prostitution as well as to that of the USA which criminalises both the buying and selling of sexual services. Thus the Nordic countries are often treated as representatives of a 'Nordic model' of prostitution policies. In this book - the first on the subject - Skilbrei and Holmström argue that these models of policies or policy regimes tend to ignore the trajectories, contexts and consequences of the full range of approaches to prostitution, thus they are too simplistic and static. Prostitution policies in the Nordic countries are multifaceted and dynamic, and cannot be represented as following a straight path and detached from empirical contexts. Their analysis treats Nordic prostitution policies both as a product of history, of current national and Nordic debates, and of international obligations and changes in the international and national prostitution markets. Furthermore they argue that a broad understanding of the relevant context is necessary so as to place Nordic prostitution policies within broader policy concerns related to gender, class, ethnicity, sexuality, social welfare, immigration and organised crime, as well as to neoliberal forms of governance.

In so doing, it set itself apart from other European states, promoting itself as the pioneer of a radical approach to prostitution. What has come to be referred to as ‘the Swedish model’ has been enormously influential, and has since been adopted and proposed by other countries. This book establishes the outcomes of this law – and the law’s justifying narratives – for the dynamics of Swedish sex work, and upon the lives of sex workers. Drawing on recent fieldwork undertaken in Sweden over several years, including qualitative interviewing and participant observation, Jay Levy argues that far from being a law to be emulated, the Swedish model has had many detrimental impacts, and has failed to demonstrably decrease levels of prostitution. Criminalising the Purchase of Sex: Lessons from Sweden utilises a wealth of respondent testimony and secondary research to redress the current lack of primary academic research and to contribute to academic discussion on this politically-charged and internationally relevant topic. Drawing on a wealth of empirical data, including extensive interview testimony and participant observation from years of fieldwork conducted in Sweden, the book debunks the widely-believed myth that Sweden is a progressive, liberal, inclusive state. In contrast to its liberal reputation, Sweden has criminalised the use of drugs and allows for compulsory treatment for those with drug dependencies. The work argues that Swedish law and policy cannot be demonstrated to have decreased drug use as intended, with the law used instead as a means with which to displace people who use drugs from public spaces in Sweden’s cities. And where the law has failed in its ambition to decrease drug use, Swedish law and policy have increased and exacerbated the problems, dangers, and harms that can be associated with it. People who use drugs in Sweden experience considerable and endemic difficulties with health, violence, abuse, and social exclusion, stigma, and discrimination as a result of Sweden’s drug laws, policies, and discourses.

Prostitution has been widely debated, condemned for its immoral and degrading nature. On the other hand, there are liberal feminists who have counter argued saying that prostitution is very empowering. The controversy surrounding prostitution has divided feminists worldwide. Radical feminists are of the opinion that prostitution is an institution of male dominance that exploits economically vulnerable and emotionally damaged women for the sake of male pleasure. In this regard, prostitutes become involuntary victims of patriarchy or conscious participants in the degradation of women. This therefore has impacts on all women as a group as prostitution continually affirms and reinforces patriarchal definitions of women as having a primary function to serve men sexually. Conversely, liberal feminists find in prostitution a practice of women’s resistance to and sexual liberation from norms and traditional moral precepts of sexuality that have long served to control and subordinate women. Others see prostitution as a means of wrestling patriarchal control over women’s sexuality that women should be at liberty to do. Prostitution therefore raises moral and legal questions. The legal question is should the practice be criminalized? In addition, the moral question is, is it wrong to sell or buy sex? These are questions I will endeavor to answer which are informed by the lived realities of women who make their living through prostitution. Prostitution or the selling of sex is, as some would call it, one of the oldest professions in the world as it has been there since time immemorial. Criminalizing prostitution seems to be a futile exercise as it is failing to achieve the intended results that of deterring other possible perpetrators; instead it just frustrates the women who engage in it as they are essentially constantly harassed by the police without any prosecution. Why are there double standards as regards prostitution; why is it that it is only the sellers and not the buyers who are penalized? Criminalization creates a culture permitting violence against sex workers and sanctions violence and discrimination against them. Sex workers are also afraid to report crimes against them, knowing that police may arrest them or may not take their claims seriously.
