Every legal order refers to the concept of justice, and Muslims also regard their religious norms (the Sharia) as offering just solutions to legal questions. But is the assumption that the Sharia is just merely an acceptance of a status quo correct? And is justice the necessary aim of the Sharia? In this volume, renowned scholars discuss these questions from different perspectives. In principle, the first normative source of Islam, the Qur'an, orders justice and fair conduct (Rohe). At the same time, an analysis of the concept of justice in the classical age of Islam (Ahmed and Poya) also shows that there existed ambivalent understandings of this concept. The relationship of the idea of justice in Islam to political questions (Ende), to war (Poya), and to modern reform (Mir-Hosseini) again confirms the importance of the concept for a critical reflection on traditional assumptions and existing circumstances. The discussion on the hijab in Western countries (Ladwig) shows paradigmatically how justice can regulate the relationship between the secular state and the Sharia. The essays in this volume endeavor to show that debates about justice, in Islam as well, express an underlying tension between the perception of an order as just on the one hand, and the feeling of injustice under the same order on the other. This discussion validates the idea that justice should be understood as a concept subject to a perpetual reexamination according to changing times and circumstances.

In our nearest environment there are people from different cultures or religions and they are part of our society. Muslims are one group that participates in our daily lives. For example, we are surrounded by many Turkish people, without really knowing which principles they follow. If we open a newspaper, we find plenty of articles dealing with Sharia, the Islamic law. There is for example the Archbishop of Canterbury who wants to integrate Islamic law into British law. And at present, the debate on headscarves in Turkish universities revives. Once in a while, we hear from women who are sentenced to death because they had unlawful sexual intercourse. But what do we really know about Muslims? Which rules do they follow and where do these rules come from? If we cannot answer this question, it is difficult to understand why there are these harsh punishments in some Islamic countries and why Islam is so important for the social development of these countries. There are Islamically inspired schools, clinics, social welfare services, and insurance and finance companies that have proliferated. Governments have to face crises of identity and political legitimacy and they are pressured to reformulate values and legislation within an Islamic framework. Some people call for the implementation of Sharia and others call for the Islamization of existing laws. In my paper, I will give an insight into Sharia and I will show how it is implemented in different Islamic countries. As this is a very complex topic, I will focus on the origin of Sharia, customs, family law, and crime and punishment, so as to explain the main principles of Muslim faith.

Book excerpt: For much of its modern history, a combination of deep nervousness and profound lack of interest seemed to inhibit or even prevent regular political conversations in the Arab World. Public spaces were devoid of political discussions: public squares in major cities showed no signs of assemblies for political purposes. If one picked up a newspaper, one was more likely to read about the comings and goings of officials rather than any sort of comprehensive political coverage. In the wake of the Arab Spring, newer media and older forms (such as the daily newspaper) have gradually made it easier for Middle East countries to participate in public debates from a variety of ideological perspectives. The state retreat from social welfare commitments have opened opportunities for a host of new informal groups and organizations to operate in areas previously dominated by officially-controlled bodies. These trends have obviously been noticed by social scientists, but scholars who focus on the large-scale political changes tend to edge into a celebratory tone: the changes are seen as potentially democratizing. Arguing Islam after the Revival of Arab Politics presents an understanding the "revived" forms of Arab politics as they really are, and does not speculate about the democratic future these changes could signal. In particular, this book examines various sites of Arab public life to explore how politics operates. Four kinds of public spheres are brought into focus: small group discussions that straddle the public/private divide (such as diwaniyyas in Kuwait or piety groups in Egypt), public spaces of assembly (such as public squares and mosques), media (both new and old), and parliaments (an institution etymologically founded in philosophizing and pontificating rather than legislating). Further, the author gives due attention to the ways in which these spheres interact to explore how these gradations, affirmations, and subversions of hierarchy, status, and power make up the current political landscape of the Middle East. The resulting work is one that is able to bridge disciplinary boundaries, offering understandings of the new political sphere. Designed to speak beyond a scholarly audience, this volume will contribute to broader public understandings of Islam in practice and of Arab politics as those who participate in it experience it.

However, as the implementers of the law have faced the social realities of women's lives and aspirations, positive changes have gradually come about. Here Ziba Mir-Hosseini takes us to the heart of the growing debates concerning the ways in which justice for women should be achieved. Through a series of lively interviews with clerics in the Iranian religious center of Qom, she seeks to understand the varying notions of gender that inform Islamic jurisprudence and to explore how clerics today perpetuate and modify these notions. Mir-Hosseini finds three main approaches to the issue: insistence on "traditional" patriarchal interpretations based on "complementarity" but "inequality" between women and men; attempts to introduce "balance" into traditional interpretations; or a radical rethinking of the jurisprudential constructions of gender. She introduces the debates among the commentators by examining key passages in both written and oral texts and by narrating her meetings and discussions with the authors. Unique in its approach and its subject matter, the book relates Mir-Hosseini's engagement, as a Muslim woman and a social anthropologist educated and working in the West, with Shii'i Muslim thinkers of various backgrounds and views. In the literature on women in Islam, there is no account of such a face-to-face encounter, either between religion and gender politics or between the two genders.
