Book excerpt: By exploring how children and their families became unprecedented objects of governmental policy in the early decades of France's Third Republic, Sylvia Schafer offers a fresh perspective on the self-fashioning of a new governmental order. In the aftermath of the Franco-Prussian War, social reformers claimed that children were increasingly the victims of their parents' immorality. Schafer examines how government officials codified these claims in the period between 1871 and 1914 and made the moral status of the family the focus of new kinds of legislative, juridical, and administrative action. Although the debate on moral danger in the family helped to articulate the young republic's claim to moral authority in the metaphors of parenthood, the definition of "moral endangerment" remained ambiguous. Schafer shows how public authorities reshaped their agenda and varied their remedies as their schemes for protecting morally endangered children broke down under the enduring weight of this ambiguity. Drawing on insights from feminist theory, literary studies, and the work of Michel Foucault, Schafer reveals the cultural complexity of civil justice and social administration in both their formal and everyday incarnations. In demonstrating the centrality of ambivalence as a condition of liberal government and governmental representations, she fundamentally recasts the history of the early Third Republic and, more widely, issues a powerful challenge to conventional views of the modern state and its history. Drawing on new material that has only recently become available from the archives of the Vichy regime, Kristen Stromberg Childers analyzes the ways fathers were promoted as saviors of the nation after France's humiliating defeat by the Germans in June 1940. Childers argues that concern for the family and for the status of fathers in modern France was not merely a response to falling birthrates and German aggression, but was fundamental to the very notion of citizenship and political participation. The debate on men as gendered beings, Childers demonstrates, is central to the political, social, and cultural history of France in the modern age. The father figure became a focus as participants from all classes and across the political spectrum debated what was wrong with the French family and what policies were needed to remedy the problem. Childers examines how these policies were implemented, what they reveal about the development of the welfare state in France, and how they help explain the importance of Vichy in twentieth-century French history. Twenty-eight illustrations, including fifteen photographs, many never previously published, complement her argument.

It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.
